<br />. <br /> <br />e <br /> <br />Page 2 of2 <br />Memo to Mayor and Council <br />Proposed Ordinance 1000-1 <br /> <br />The next change requires all new licenses or renewals to be processed with 1) the requirements <br />that 65 % of the gross income of the establishment be derived from the sale of food prepared in <br />an on-site kitchen; and 2) the policy guidelines of Resolution 91-12 enforced. This provision <br />will see that all new licenses and renewals include the same provisions. Presently, the City <br />renews these licenses as they were initially drafted. Therefore, some licenses include the 65 % <br />test and some do not. Likewise, some businesses whose licenses are renewed may not comply <br />with the policy guidelines in Resolution 91-12 (attached). Fortunately, most of the businesses <br />that would be subject to these provisions are no longer operating. Barbour's Cut Blvd. <br /> <br />Renewal Date: July 6, 1997 <br /> <br />And finally, Section 5 of the Ordinance provides that the City shall not issue or renew any <br />permit for the sale of on-premises consumption of wine andlor beer under the Ordinance, unless <br />all city and school taxes have been paid by the applicant and owner of the property covered by <br />the application, and unless the applicant and property owner are current on any other real or <br />personal property taxes located or to be operated within the City of La Pone. This language <br />should prevent the issuance of renewal permits to operators of wine andlor beer establishments <br />that are delinquent on their ad valorem taxes. The Ordinance makes it the responsibility of the <br />applicant to provide the City with statements showing that all ad valorem taXes are current. <br /> <br />Upon Council's direction, a final draft of the Ordinance will be produced and staff will prepare <br />a letter notifying all current license holders of the proposed Ordinance provisions. <br /> <br />EXHIBrr A <br />
