For the term stated in Article 1-2 hereof, property at <br />the Airport, consisting of 25 Tie-Downs, identified as <br />"Tie-Down Areas" on Exhibit "B" attached hereto and made <br />a part of this Agreement. Any ekisting tie-downs, the <br />location of which would impede Lessee's access to its new <br />facilities, shall be excluded from this lease, and an <br />equal number of tie-downs will be substituted on the ramp <br />area. <br /> <br />The location and boundaries of said Leased Premises, as indicated <br />on Exhibit "A" and Exhibit "B", attached hereto, are stipulated and <br />agreed between the parties to be correct and by reference are made <br />a part hereof. <br /> <br />2. Lessee takes all of such property in its present condition "as <br />is", and except as otherwise specifically provided herein, agrees <br />to provide all necessary and reasonable maintenance and repairs to <br />the property described on Exhibit "A", in order to maintain such <br />property in a usable condition. <br /> <br />3. Lessee shall make available to the public for rental purposes, <br />tie-down facilities leased to Lessee herein. In its rental of such <br />tie-down facilities, the Lessee shall provide reasonable rental <br />rates, consistent with industry standards for this region. <br />Notwithstanding any other provision of this Agreement, the parties <br />recognize and agree that Lessee is not herewith given and shall not <br />exercise exclusive control over the ramp area not specifically <br />leased under this Agreement; and that the public shall have the <br />right, at all.time, to ingress and egress, over and through said <br />ramp area, as reasonably necessary for the use by the public of <br />airport facilities at La Porte Municipal Airport. <br /> <br />4. The Lessor expressly reserves from the lease of the Leased <br />Premises the following: <br /> <br />A. All gas, oil and mineral rights in and under the soil. <br /> <br />B. The right to grant utility rights-af-ways to others over, <br />under, through, across or on the Leased Premises, <br />provided that such use will not unreasonably or <br />materially interfere with the Lessee's use of the Leased <br />Premises. <br /> <br />5. The Lessor agrees to construct, at Lessor I s sole cost and <br />expense, as an appurtenance to the Fixed Base Operator Area, the <br />infrastructure, including roadway; an eight inch (8") water line; <br />an eight inch (8") sewer line; and storm drainage, all as shown on <br />Exhibit "B" attached hereto, and incorporated by refere~ce herein <br />for all purposes. Lessor agrees to complete the construction of <br />said infrastructure improvements on or before December 31, 1998. <br />Lessee shall advise Lessor of the location of stubbouts for the <br />water and sewer service connections to Lessee's building. <br /> <br />3 <br />
