<br />REoIsT FOR CITY COUNCIL AG.DA ITEM <br /> <br />Agenda Date Requested: 10-26-2 <br />Requested By: Doug Kneupp <br />Report <br /> <br /> <br />Planning <br />XXX Ordinance <br /> <br />Exhibits: <br /> <br />Ordinance with Industrial District Agreement <br />Ordinance with Water and Sanitary Sewer Service Agreement <br />Ordinance with Utility Extension Agreement <br /> <br />Summary & Recommendation <br /> <br />On June 10, 1991, Council authorized the City Manager to present DANA TANK CONTAINER, INC. <br />a letter of intent to supply water and sewer and to formulate a modified Industrial District Agreement. <br />The City Manager delivered the letter of intent on June 20, 1991 and initiated negotiations consistent with <br />guidelines previously presented to City Council. <br /> <br />On January 26, 1998, Council authorized the City Manager to offer the following Agreements to <br />DANA TANK CONTAINER, INC.: <br /> <br />1.) Industrial District Agreement (with limited utilio/ service) <br />This Agreement was prepared by taking the City's standard IDA and modifying it to fit the <br />concepts approved by Council in June 1991. The key differences are: <br /> <br />. DANA agrees to abide by ordinances that deal with all aspects of being a utility customer of the City. <br />. DANA agrees to submit site plans for future expansions and improvements for City review for <br />compliance with Comprehensive Plan. (One specific concern is the FI0l Watershed Plan) <br />. The term of the IDA is consistent with all other IDA's in the Battleground Industrial District. The <br />agreement expires on 12/31/00. <br />~ DANA agrees to pay in-lieu taxes as if they were fully annexed by the City. <br /> <br />2J Water and Sewer Service Agreement <br />This Agreement was prepared by taking the standard form of agreement for water service to <br />industry (approved by Council on May 8, 1995) and modifying it to fit the concepts approved by Council <br />inJune 1991. The key features and/or differences are: <br /> <br />. The limits of water and sewer service are based on the requests made by DANA in 1991, and <br />reviewed by Council and are J!Qt based on our current policy of 50 gal per employee per day adopted <br />in May 1995. <br />. DANA agrees to pay City $114,355.00 for participation in City's construction costs for extending <br />casings and carrier pipe across SH225 (this is the estimate of construction costs that DANA would <br />have incurred to serve their site.) <br />. The expenses incurl."ed by DANA under terms of the Utility Extension Agreement to connect <br />utility mains to the SH225 crossing will be credited against the $114,355.00 contribution.(est. <br />$29,095) <br />. DANA agrees to construct enough sanitary sewer storage on-site to accommodate no less than <br />four times the average daily wastewater demands. <br />. DANA agrees that during periods when the City's collection system is surcharged, the City may <br />require them to cease use of the sanitary sewer service for periods up to thirty-six (36) hours. <br />. City shall have the right to interrupt or temporarily suspend service, in the event of an emergency <br />in order to serve the citizens of La Pone. <br />
