<br />. DANA agrees to abily all rules, regulations, policies and ord.ces relating to utility <br />customers of the City. <br />~ The term of the agreement is for five (5) years and any agreed renewal and extensions as long as <br />there is a valid Industrial District Agreement in place. <br /> <br />3.) Utility Extension Agreement <br />This agreement was developed by taking the standard Utility Extension Agreement and <br />modifying it to fit 'this particular situation. In summary, key features of this agreement are: <br /> <br />. DANA agrees to construct and install <br />1. Approximately 400 foot of 8" waterline and appurtenances (connects the SH225 waterline <br />crossing to the City's water system) <br />2. Approximately 800 foot of 15" gravity sewer line and appurtenances (connects the SH225 <br />sewer line crossing (force main) to the City's sanitary sewer system). <br />3. NOTE: the cost of the above construction (estimated $29,095.00) will be credited against the <br />$114,355 estimated cost for DANA if they had constructed utilities to serve their facility. <br />4. Any other extensions, repairs or maintenance required to make the 8" waterline crossing of <br />SH225 fully operational. <br />5. Lift stations and related facilities required to transport wastewater into the City's (gravity) <br />collection system. This will be a privately owned and maintained lift station. <br /> <br />. This agreement also provides that: <br />1. City shall approve plans and specifications. <br />2. City shall approve the engineers and contractor. <br />3. City shall provide daily inspection and approve all payments to contractor. <br />4. DANA to be responsible for securing necessary right-of-way, easements, licenses and/or <br />permits at no cost to the City. <br />5. A one year warranty from defects in materials and workmanship will be included. <br />6. DANA is not due any reimbursements from City or adjacent property owners for any future <br />connections to these utilities. <br /> <br />In summary, staff has constructed these agreements to fit the concepts outlined in 1991 and also used the <br />terms of our current standard Water Service Agreement with Industry, except where they conflict with <br />this specific utility request approved by Council in 1991. <br /> <br />Action Required by Council: <br /> <br />Consider approving Ordinances authorizing the execution of an Industrial District Agreement, Utility <br />Extension Agreement, and Water and Sanitary Sewer Service Agreement with DANA TANK. <br />CONTAINER, INC. <br /> <br />Availability of Funds: Not Applicable <br />General Fund <br />CapitaH.
