e e controlled by or under the same common control as Grantee, as long as such entity has expertise in the operation of a Cable System. Grantee shall demonstrate that the assignee has the financial resources necessary to fulfill the requirement of the Franchise, as well as Grantee's compliance with the tenns of this Franchise. Grantee shall give written notice to the Director of such assignment. Section 30. THE GRANTEE TO HAVE NO RECOURSE. 1. Requirements and Enforcement. Except as expressly provided herein, and subject to applicable law, the Grantee shall have no monetary recourse against the City for any loss, cost, expense or damage arising out of the provisions or requirements of this Franchise or because of the enforcement thereofby the City or because of the lack of the City's authority to grant all or any part of this Franchise. 2. The Grantee's Understanding. The Grantee expressly acknowledges that in accepting this Franchise, it relied solely upon its own investigation and understanding to the power and authority of the City to grant this Franchise and the Grantee was not induced to accept this Franchise by any understanding, promise, or other statement, verbal or written, by or on behalf of the City, or by any third person concerning any tenn or condition not expressed herein. 3. Construction of Franchise. By acceptance of this Franchise, the Grantee acknowledges that it has carefully read the provisions hereof and is willing to and does accept all of the risks ofthe meanings of such provisions, subject to applicable law. Section 31. ACCEPTANCE OF FRANCHISE. Within thirty (30) days following the final passage and approval of this Franchise, the Grantee shall file with the City Secretary a written statement in the following (onn signed in its name and behalf: "To the Honorable Mayor and the City Council of the City of La Porte, Texas: 29
