(b) Before the eleventh day after the building is secured, .the building official <br />shall cause notice of the action to be given by personal delivery, mail, publication or <br />posting to the owners and others who may have an interest in the building as provided <br />in Section 214.0011(c) of the Texas Local Government Article. The notice shall contain <br />the information specified in Section 214.0011(d) of the Texas Local Government Article. <br />(c) If within thirty (30) days after the date the building official secures the <br />building or causes the building to be secured, the owner files with the Planning Director <br />a written request for a hearing, then a hearing shall be conducted within twenty (20) <br />days after the date the request is filed. The hearing shall be conducted in the same <br />manner as provided elsewhere in this Article, and the owner may testify or present <br />witnesses or written information about any matter relating to the city's securing of the <br />building. <br />(d) If either (i) no hearing is requested or (ii) a hearing is requested and the <br />hearing officer decides that the action taken to secure the building was justified under <br />the criteria of this Article, the city may place a lien against the property upon which the <br />building is situated for the costs and expenses incurred by the city in securing the build- <br />ing in the same manner as provided in Section 4.09 of this Article. <br />(e) The provisions of this Section are cumulative of all other remedies. <br />Without limitation, the building official may cause a building to be secured under this <br />Section and still schedule and conduct a hearing in the same manner as provided <br />elsewhere in this Article, if there is reason to believe that repair or demolition of the <br />property is necessary or desirable to protect further the life, health and safety of the <br />public. - <br />Section 5.02. Duty of city employees to report dangerous buildings. <br />It shall be the duty of all city employees whose responsibility it is to enforce this <br />Article, the Building Article or the Fire Article of the city to make a report in writing to the <br />building official of all buildings they believe are dangerous buildings. Such reports are to <br />be made within a reasonable time after the discovery of such building. <br />Section 5.03. Notice by building official. <br />(a) The building official may issue to each owner of a building notice that the <br />building must be secured under this Article, if all of the following conditions exist: <br />(1) The structure is in violation of the terms of this Article, and is <br />vacant; <br />(2) The structure has a watertight roof and does not appear to be <br />unstable, in danger of collapse or otherwise in a rapidly deteriorat- <br />ing condition; <br />Page 14 <br />
