(3) The structure does not have exterior structural wall(s) containing <br />fire, water, or wind damage of more than fifty (50%) percent of any <br />such wall; <br />(4) The structure does not contain or promote accumulation of refuse, <br />vegetation, water, or other matter creating breeding places for <br />rodents, insects, or other pests; and <br />(5) The condition of the structure appears to be such that the structure <br />may reasonably be secured and, as secured, would not present <br />any significant risk to the health, safety and welfare of the public. <br />(b) Each notice shall advise the owner that the owner may file a protest of the <br />notice within ten (10) days of its receipt. The notice shall also advise the owner of the <br />place and manner in which the protest may be filed. If any owner of a building timely <br />files a protest, the building official shall withdraw the notice and immediately refer the <br />matter for a hearing under Section 5.15 of this Article or to the Commission under <br />Section 3.03 of this Article. <br />(c) If a building is required to be secured under this Article, the owner may <br />secure it by either (i) obtaining a securing permit pursuant to the requirements of this <br />Article and securing such building in conformity therewith, or (ii) if reasonably possible, <br />obtaining an appropriate repair permit and, pursuant thereto, repairing or replacing all <br />doors, windows and other openings such that they remain closed and locked. <br />Section 5.04. Offense - <br />It shall be unlawful for any person to secure a vacant dangerous building without <br />the necessary permit, regardless of whether the securing is done pursuant. to an order <br />issued under this Article. <br />Section 5.05. Application for permit; amendments. <br />(a) Any person required to secure a building pursuant to an order issued <br />under this Article shall obtain a securing permit issued pursuant to this Article. Any <br />person requiring or desiring a securing permit shall make written application to the <br />building official. The application shall include an affidavit by the applicant stating the full <br />name(s) of the legal owner(s) of the building, the current residence and business <br />mailing addresses and telephone numbers of the owner(s), and of the applicant, if <br />different from the owner, and the city's ad valorem tax account number(s) for the <br />property. A separate application and permit shall be required for each vacant building. <br />(b) Not less than thirty (30) days nor more than sixty (60) days prior to the <br />expiration date of the permit, application may be made for a renewal of the permit. If the <br />application is not timely filed, then the permit shall not be subject to renewal, and the <br />owner must file an original permit application. <br />Page 15 <br />
