0 0 <br />held within seven (7) working days of request. If no request for a hearing is made with the time <br />limits provided, the denial, suspension, or revocation is sustained. <br />B. Service of Notice: A notice provided for in these rules is properly served when it is delivered to <br />the permit holder or person in charge, or when it is sent by registered or certified mail, return <br />receipt requested, to the last known address of the holder of the permit. A copy of the notice <br />must be filed in the records of Harris County Public Health and Environmental Services. <br />C. Hearing: The hearing shall be conducted by Harris County Public Health and Environmental <br />Services at a time and place designated by it. Based upon the recorded evidence of such <br />hearings, the Director of Harris County Public Health and Environmental Services shall make a <br />final finding, shall sustain, modify or rescind any notice or order considered in the hearing. <br />The Regulatory Authority shall furnish a written report of the Hearing decision to the holder of <br />the permit. <br />VI. APPLICATION AFTER REVOCATION <br />Whenever a revocation of a permit has become final, the holder of the revoked permit shall <br />make written application for a new permit, and, if necessary, the food establishment may be required to <br />submit plans and be subject to a pre -opening inspection. <br />VII. CRIMINAL PENALTY <br />A. A person commits an offense if the person operates a food establishment without a permit from <br />Harris County. <br />B. An offense under this Section is a Class C Misdemeanor. <br />C. Each day on which a violation occurs constitutes a separate offense. <br />VIII. INJUNCTION <br />The County Attorney may sue in district court to enjoin a food service establishment, retail <br />food establishment, mobile food establishment, roadside food vendor, or pushcart from operating <br />without a permit, if one is required. <br />IX. ADDITIONAL REQUIREMENTS FOR MOBILE FOOD ESTABLISHMENTS <br />(INCLUDING PUSHCARTS AND ROADSIDE FOOD VENDORS) <br />A. All mobile food establishments shall be readily identifiable by business name, printed in bold <br />black letters not less than three (3) inches in height, not less than one and a half (1%) inches in <br />width, permanently affixed, and prominently displayed upon at least two (2) sides of the units. <br />B. Prior to the approval of the initial permit or renewal of an existing permit".the applicant or <br />permit holder shall provide written details or plans regarding the systems installed for approved <br />water source, distribution, delivery, and retention system and for waste, sewage, and <br />wastewater retention, drainage, and delivery, and disposal or removal system for the mobile <br />food establishment or unit. <br />
