C. A pushcart unit shall not exceed four (4) feet in width, eight (8) feet in length and eight (8) feet <br />in height including a unit's shade umbrella. In the event of an emergencv situation. the unit <br />shall be easily movable, controllable, and maneuverable by one (1) person when the unit is <br />fullv loaded. The bottom of the unit shall be at least one (1) foot from the ground. The unit <br />shall be non self-propelled. <br />D. Live animals shall be excluded from immediate adjacent surrounding areas of all mobile food <br />establishments. <br />E. If toilet facilities are not provided on a mobile food establishment, a toilet facility shall be <br />located within 500 feet. However, this provision does not apply to restricted mobile units. <br />F. All motor vehicles operating as mobile food establishments 'upon open roads, streets, and <br />highways, shall maintain a current Texas motor vehicle inspectian "sticker and'a current Texas <br />motor vehicle license plate registration sticker. <br />G. In addition to state law and rules imposed on all mobile food establishments, the following <br />additional requirements are imposed on ice cream trucks: <br />1. The ice cream truck shall have displayed warning signs that state "CAUTION <br />CHILDREN" that are visible from the front and the rear of the unit. The letters shall be at <br />least six (6) inches in height, at least three (3) inches in width, with bold black lettering on a <br />yellow background, placed at the top, center portion of the truck, in front of, but not <br />obstructing the view of any flashing lights. <br />2. The ice cream truck, while in operation, shall have flashing yellow lights that are clearly <br />visible from the front of the unit and flashing red lights clearly visible from the rear of the <br />unit. These lights shall be placed on both sides of the "CAUTION CHILDREN" sign. <br />X. FEES <br />The following fees are to be paid in connection with applications submitted pursuant to these <br />Rules for the issuance or renewal of a permit. <br />Food Establishment Permit Fee <br />Category A� <br />$250 <br />Category B <br />$175 <br />Category C <br />$100 <br />Category D.... <br />$50 <br />Mobile Food Establishment <br />$150 <br />Roadside Food Vendor <br />$75 <br />Temporary Food Permit (14 Days) <br />For timely application <br />$50 <br />For untimely application or on -site issuance <br />$100 <br />Seasonal Permit (120 days) <br />$100 <br />Category A: any place where raw, potentially hazardous food is processed or prepared. <br />Category B: any place where food preparation involves only reheating and/or serving of potentially hazardous <br />food or the processing of nonpotentially hazardous food or precooked potentially hazardous food. <br />Category C: any place where only nonpotentially hazardous foods and/or prepackaged potentially hazardous foods are <br />served or sold. No food processing is involved. <br />Category D: any place, permanent or seasonal, serving or offering for sale crushed or shaved ice made in conjunction <br />with a sugar and water based syrup that is essentially a nonpotentially hazardous food. <br />
