<br />...,) <br /> <br />diligence and promptness, the Owner may, without prejudice to other remedies the Owner <br />may have, immediately correct such deficiencies. In such case, an appropriate Change Order <br />shall be issued deducting from paYments then or thereafter due the Contractor the cost of <br />correcting such deficiencies, including Owner expenses and compensation for the <br />Architect's additional services and expenses made necessary by such default, neglect or <br />failure such Change Order shall be deemed signed by the Contractor for the purposes stated <br />in Subparagraph 7.2.1 even if the Contractor fails to physically sign such Change Order. <br /> <br />ARTICLE 3 - CONTRACTOR <br /> <br />3.2 REVIEW OF CONTRACT DOCUMENTS AND FIELD CONDITIONS BY <br />CONTRACTOR <br /> <br />At Subparagraph 3.2.1, add Clause 3.2.1.2 <br /> <br />.2 The Contractor shall examine the site of the Work and adjacent premises and the <br />various means of approach to the site, and shall make all necessary investigations in <br />order to inform itself thoroughly as to the character and magnitude of all work <br />involved in the complete execution of the work shown in the Contract Documents. <br />The Contractor shall further inform itself as to the facilities for delivering, handling, <br />and installing the construction plant and other equipment and the conditions and <br />difficulties that will be encountered in the performance of the Work. No plea of <br />ignorance of condition that exist or that may hereafter exist, or ofthe difficulties that <br />will be encountered in the performance of the work, as a result of failure to make <br />necessary examinations and investigations, will be accepted as sufficient excuse for <br />any failure or omission on the part of the Contractor to fulfill in every detail all the <br />requirements of the Contract Documents or will be expected as a basis for any claim <br />whatsoever for extra compensation or for an extension of time. <br /> <br />Add the following after first sentence of Subparagraph 3.2.2: <br /> <br />The accuracy of grades, elevations, dimensions, or locations of existing conditions is not <br />guaranteed by the Architect or Owner, and the Contractor is responsible for verifying same. <br /> <br />Add Subparagraphs 3.2.4,3.2.5,3.2.6 and 3.2.7 asfollows: <br /> <br />3.2.4 The Contractor shall not be entitled to additional compensation for the "rework <br />portion" of any additional work caused by failure to carefully study and compare the <br />contract documents prior to execution of the work. <br /> <br />3.2.5 The Contractor shall make reasonable attempt to interpret the Contract Documents <br />before asking the Architect for assistance in interpretation. The Contractor shall not ask the <br />Architect for observation of work prior to the Contractor's field superintendent's personal <br />inspection of the work and determination that the work complies with the Contract <br />Documents. <br /> <br />4 <br />
