<br />J.Ji <br /> <br />action to complete corrective work out ofthe remaining Contract funds in accordance with <br />Paragraph 14.2. <br /> <br />9.10 FINAL COMPLETION AND FINAL PAYMENT <br /> <br />At Subparagraph 9.10.2, Add the following sentence: <br /> <br />Prior to final payment, the Contractor shall meet all of the requirements of Section 01770, <br />Close Out Procedures. <br /> <br />Add Subparagraph 9.10.6 asfollows: <br /> <br />9.10.6 Final payment, constituting the entire unpaid balance ofthe Contract Sum, shall be <br />paid by the Owner, to the Contractor, thirty-one (31) days after Substantial Completion of <br />the work unless otherwise stipulated in the Certificate of Substantial Completion, provided <br />the Work has been completed, the Contract fully performed, all of the requirements of <br />Section 01770 Close Out Procedures, are met and the Final Certificate for Payment has been <br />issued by the Architect. Partial release of retainage and final payment will not be made until <br />all of these conditions are met. <br /> <br />9.11 LIQUIDATED DAMAGES <br /> <br />Add the following Paragraph 9.11 as follows: <br /> <br />9.11 The Contractor and the Contractor's surety shall be liable for and shall pay the <br />Owner the sums hereinafter stipulated as liquidated damages for each calendar day of delay <br />after the date established for Substantial Completion in the Contract Documents until the <br />Work is substantially complete. From the compensation otherwise to be paid, the Owner <br />may retain the sum of$1000.00, for each calendar day that the work remains uncompleted, <br />which sum is agreed upon as the proper measure ofliquidated damages that the Owner will <br />sustain per day upon the failure of the Contractor to substantially complete the work in the <br />time stipulated, and this sum is not to be construed in any sense as a penalty. <br /> <br />ARTICLE 10 - PROTECTION OF PERSONS AND PROPERTY <br /> <br />Add Subparagraphs 10.1.2, 10.1.3 and 10.14 asfollows: <br /> <br />10.1.2 The Contractor shall provide a written Project Site Safety Program, maintain injury <br />records as required by OSHA, keep the Owner informed of all serious and/or lost time <br />injuries, and make available to the Owner information on injury logs, safety meetings <br />including topics and a sign-in sheet for each meeting, inspection reports and other items <br />concerning Project safety. <br /> <br />18 <br />
