<br />- <br /> <br />The Developer's Agreement has various exhibits attached. An enhanced <br />amenity plan of Taylor Bayou shall be approved by the City. The <br />maintenance of the reserves and easements, duly recorded with Harris <br />County, will be the responsibility of the PID pursuant to the provisions of <br />the SCUP. <br /> <br />- <br /> <br />It is further stated that the developer intends to record the plat for Section <br />1 once the City has accepted the infrastructure. The following list will be <br />considered as "Developer Items": <br /> <br />- <br /> <br />· Sound wall along State Highway 146 <br />· Upgrade wood fence along Wharton Weems Blvd. <br />· 4' high ornamental iron fence along golf course <br />· Entry monumentation <br />. Landscaping <br />· School bus stops <br />· Determine and agree to the level of participation and schedule for <br />payment for the signalization of Wharton Weems Blvd. at State <br />Highway 146. <br />· Rear lot line fences adjacent to the pedestrian trail or similar <br />amenity, with specifications the same as the fence along golf <br />course, will be passed on to the builder subject to the approval by <br />the City. <br /> <br />- <br /> <br />- <br /> <br />- <br /> <br />Completion of these items shall continue following recordation of the Final <br />Plat for Section 1. Anticipated completion date for these items is May <br />2008. Failure to accomplish the "developer's items" may give cause for the <br />TIRZ Board to withhold further increments in this regard. All fence <br />designs, once approved by the City, will be forwarded to the TIRZ Board <br />for further approval. Developer will furnish to the City approved and <br />executed agreements with the subsequent builders assigning any <br />construction or installation responsibilities along with a schedule of <br />construction prior to the issuance of any building permits. In addition, final <br />plats on successive phases shall not be approved until "Developer Items" <br />on current sections under construction are completed. <br /> <br />- <br /> <br />- <br /> <br />Covenants, Conditions, and Restrictions (CCRs): <br /> <br />The declaration of covenants, conditions, and restrictions is a typical <br />document similar to the other conventional single-family subdivisions with <br />a notable provision of "hold harmless clause for golf course lots". It is <br />stated that the homeowners are responsible for all costs of repair that are <br />incurred when property adjacent to the golf course and driving range is <br />damaged by golf balls straying onto such areas. The City of La Porte shall <br />not be responsible for any claims, liabilities, court costs, losses and/or <br />damages in any case. <br /> <br />- <br /> <br />- <br />
