bayou Forest Apts. — Pre iminary Plat • <br />7/17/97 - P&Z Meeting <br />Page 2 <br />• On April 21, 1994, the Planning & Zoning Commission was <br />again asked to look at this tract. The property owners had re- <br />evaluated their development options and felt the rezoning of a <br />portion of the R-1 property (i.e. 17 acres) to P.U.D. and the <br />land use change to" Mid to High Density Residential" opens <br />the possibility of placing higher density housing or apartments. <br />The Commission recommended approval to City Council of <br />Rezone Request #R94-001. The request asked for the rezoning <br />of a 17 acre tract out of the original 107.35 acres. Request <br />#R94-001 asked that a 17 acre tract be rezoned from R 1 to <br />P.U.D. The overall tract would be composed of 83.59 acres <br />zoned R 1 and 6.7526 acres zoned NC and the new 17 acre <br />tract zoned P.U.D. <br />• In the May 23, 1994 meeting City Council passed and <br />approved Ordinance 1501-R which authorized the P.U.D. <br />zoning of the new 17 acre tract. <br />Analois: A comparison of the P.U.D. tract and NC tract approved in 1994 <br />and the general plan submitted show that the proposed apartments <br />are located within the P.U.D. zone. In considering this request staff <br />reviewed the intent and goals of the Comprehensive Plan as they <br />apply to this portion of the City. The Bayou Forest Apartments <br />Preliminary Plat being considered at this time is only 10.54 <br />acres out of the original 17 acre P.U.D. tract. To ensure proper <br />planning only the 10.54 acres is to be considered as part of the <br />Preliminary Plat for the Bayou Forest Apartments. <br />Each of these plats will be reviewed in accordance with the <br />guidelines established for (depending on the acreage of the section) <br />major or minor subdivisions. As the property is designated P.U.D., <br />the applicant must also submit an application for a conditional use <br />permit. (Note. The Special Conditional Use Permit will be acted <br />on during the July 14,1997 City Council meeting.) <br />Using the Development Ordinance as a guide, Staff has reviewed <br />the Bayou Forest Apartments Preliminary Plat and found it <br />complies with the requirements on the checklist. <br />1. Approve the Preliminary Plat as filed; <br />2. Conditionally Approve the Preliminary Plat as filed, provided <br />the reasons for such conditional approval are stated in writing <br />and a copy of the statement is signed by the Chairman of the <br />Planning & Zoning Commission; <br />
