If these <br />easements affect Section VI, they should be properly noted on the final <br />plat. <br />Conclusion: Development Ordinance, Section 4.03.B requires that "following review <br />of the Preliminary Plat, the commission shall ... Take one of the following <br />actions." <br />1. Anyrove the Preliminary Plat as filed; <br />2. Conditionally Approve the Preliminary Plat as filed, provided, the <br />reasons are stated in writing and a copy of the statement is signed <br />by the Chairman of the Planning Commission. <br />3. Disapprove the Preliminary Plat as filed, provided, the reasons for <br />such disapproval are stated in writing and a copy of the statement <br />is signed by the Chairman of the Planning Commission. <br />Using Appendix D of Development Ordinance No. 1444, staff has reviewed <br />the preliminary plat and finds it substantially complies with applicable <br />ordinance requirements. The completed checklist and the title report are <br />attached and follow this report. Staff therefore, recommends Approval of <br />the Fairmont Park East, Section VI Preliminary Plat. <br />If the Planning and Zoning Commission approves the Preliminary Plat we <br />recommend the motion include the following: <br />• Confirmation by the Planning and Zoning Commission that sidewalks <br />aze required in Fairmont Pazk East, Section Vi. <br />• The Planning and Zoning Commission requests that staff notify the <br />developer of the items referenced in this report that need to be addressed <br />with submittal of the final plat. <br />
