Consistent with the terms of the D~velopment Agreement, signage for the <br />track shall be uniform and shall follow a consistent design throughout the development. A sign <br />cOnsultant or other qualified design professional shall be utilized to develop,such uniform and <br />consistent signage plan throughout the tract and the plan that is developed shall be approved by <br />the City of La Porte and be enforced throughout the tract by the Association. No deviation in <br />signage shall be permitted except by recommendation of the Board of the Property Owners <br />Association (Association) and approved by the Planning Director of the City of La Porte upon <br />such recommendation. Consistent vvith this provision, prior to execting any sign, detailed <br />drawings and specifications for such proposed sign, incl~ding, without limitation, site information <br />signs, shall be submitted to the Grantor for its prior written approval. The design and material of <br />every sign on the Property must be approved in writing by the Association. Unless otherwise <br />approved in writing by the Grantor, all signs must be attached to a building, parallel to an4 <br />contiguous with its wall, and must not project above its roof line. No mobile or portable sign and <br />no sign with flashing lights or moving characters, or designed to imitate moving lights or flashing <br />characterS, shall be permitted,. No signs may be painted on ~uildings' or other structures unless <br />otherwise approved in writing by the Grantor. No sign (other than traffic control signs and <br />informational signs erected by or with the permission of the Association) may be erected in any <br />street right-of-way or other easement. With the prior written consent of the Association, <br />temporary signs may be erected in the setback areas of a Building Site for the sole purpose of <br />advertising the leasing of the Building Site or businesses to be conducted thereon, or the sale <br />thereof, and such signs may be larger and of a different character than permanent signs. All <br />temporary signs must be removed when the principal building on the applicable Building Site is <br />substantially leased or sold. If, at any time; the purchaser, owner, user or lessee of any Building <br />Site shall be in violation of this Sect~on 12, the Association, without being deemed to be guilty of <br />a trespass and without being otherwise liable to such purchaser, owner, or user, lessee, or any , <br />other'person, may enter upon the Building Site or any part ihereofand may remove any sign not <br />complying with the Section 12 or not previously approvecfas herein required. For purposes of <br />this Section 12, together with interest thereon from the date the costs are incurred until repaid at <br />the maximum nonusurious rate ofinterest allowed by applicable law, shall be due,arid payable by <br />the owner ofthe applicable Building Site upo~ demand. The repayment of such sums shall be <br />secured by the mechanic's lien created by Section 15 below as ifsuch.costs were incurred in <br />perfonning maintenance on such Building Site., All approvals by Association, required by this ' <br />Section 12 shall not be unreasonably withheld, conditioned or delayed. <br /> <br />13. Temporal)' Structures. No temporary building or structure other than construction , <br />offices and structures related to construction shall be installed or maintained on any Building Site. ' <br />All temporary structures used for construction purposes ~ust receive prior approval from the ' <br />Grantor with regard to location and appearance, and must be removed promptly upon substantjal <br />completion of construction of the building or improvement to which.they re~ate. <br /> <br />'-14. Easements. No structure shall be erected on any easement within the Property, and <br />no improvement may be placed within such easements, without prior written approval of the <br />Grantor and the holder of such easement rights. Easements may be crossed by driveways, p~king <br />areas, landscaping, and walkways upon receipt of the prior written approval of the holder of such <br />easement rights and provided appropriate measures an~ taken tQ protect the pipes, lines and <br />
