<br />SCU06-006 <br />August 17, 2006 <br />Page 2 of8 <br /> <br />Analvsis: <br /> <br />10, 2002, City Council approved General Plan, Development Agreement <br />and SCU#02-002. Later on, a one year extension was subsequently <br />granted in June 2003 which expired in June 2004. <br /> <br />Owner/developer submitted another application for Special Conditional <br />Use Permit SCU#04-011. The Planning and Zoning Commission, at their <br />meeting on June 17, 2004, held a workshop and discussed the following <br />issues: <br /> <br />. Site plan submittal <br />. Dedication/improvement to Powell Rd. <br />. Phase I-A development (strip of land contiguous to UPRR <br />containing two rail lines ) <br />. Phase I development (first warehouse, with rail access) <br />. Access from Powell Rd. Traffic flow concept for entire project <br /> <br />The outstanding issues were too complex to come to any conclusion at that <br />time. In addition, the subject property was under litigation. Therefore, the <br />application was withdrawn. <br /> <br />As a part of the Planned Unit Development (PUD) development process, a <br />Special Conditional Use Permit SCU#05-003 and General Plan covering the <br />La Porte 81 Ltd., La Porte 82 Ltd., La Porte 115 Ltd., and La Porte 146 <br />Venture, LP., (c/o Russell Plank) were approved by City Council on March <br />28, 2005. Later, the applicant requested a I-year extension of this Special <br />Conditional Use Permit, which was granted by the Planning and Zoning <br />Commission at the February 16, 2006, meeting. <br /> <br />This is an ongoing project that is to be developed in phases. As the project <br />proceeds, it shows progress with the new developers. The applicant <br />submitted a preliminary plat for Phase I, Section 1 consisting of 12.342 <br />acres. The subject plat was approved by the Planning and Zoning <br />Commission at the January 19, 2006, meeting. Later, a Final Plat was <br />approved at the March 16, 2006, meeting. In addition, a development site <br />plan has been approved and the building permit was issued by the City. <br /> <br />Section 106-659 of the Code of Ordinances establishes the follqwing criteria <br />for review of the development projects within a P.U.D. zone. <br /> <br />Land Use - The General Plan contains information regarding the <br />development of approximately 300:1: acre site. The plan's significant <br />features include contemplated land uses, open space and storm water <br />detention areas, landscape and buffer areas and roadway network. The <br />
