<br />SCU06-006 <br />August 17, 2006 <br />Page 3 of8 <br /> <br />Development Agreement defines the land uses that are acceptable within <br />various tracts of this development. <br /> <br />Landscaping/Open Space - The General Plan shows the relationship of <br />landscape/open space and also demonstrates how the trail system, open <br />space, and the storm water detention system are interrelated. The City may <br />elect to accept these facilities depending on the final design of the project. <br />Buffering and beautification is also addressed in the Development <br />Agreement. In addition, landscaping will be provided within building <br />setback areas and easements throughout the project. Staff is anticipating that <br />a consistent theme and design criteria shall be implemented throughout this <br />development. <br /> <br />Transportationffraffic Control Plan - Truck traffic is typically associated <br />with this type of commercial and industrial development. The developer has <br />submitted on traffic analysis plan. The development agreement contemplates <br />that all trucks will enter and leave the site via State Highway 146 and <br />Wharton Weems Boulevard and no trucks will proceed north along S. 16th <br />Street (Powell Road) to Fairmont Parkway. It is anticipated that most of the <br />traffic will use State Highway 146 Frontage Road. However, Export Drive <br />will reduce the truck traffic on Powell Road by allowing ingress and egress <br />to and from State Highway 146 from Powell Road. <br /> <br />Utilities - All infrastructures shall be upgraded to provide potable water, <br />suitable fire protection, sanitary sewer, storm water, and roadways. Storm <br />water facilities and roadways will be designed in accordance with the City of <br />La Porte, Harris County, and Harris County Flood Control District <br />requirements. The design of the site infrastructure will be reviewed with the <br />site plan submittal and construction drawings in accordance with the Public <br />Improvement Criteria Manual (PICM). <br /> <br />Recognizing that the project is moving along with the respective <br />submittals and approval process, Staff and the developer created a <br />development proposal. All applicable elements of the Comprehensive Plan <br />are reviewed and incorporated into this development proposal. However, <br />owner/developer has expressed concerns that present conditions have <br />mandated changes to the Developer's Agreement associated with <br />SCU#05-003. Staff and the owner/developer have worked on the <br />Development Agreement and Declaration of Covenants, Conditions, and <br />Restrictions associated with this development. If approved, Special <br />Conditional Use Permit SCU#06-006 will supersede Special Conditional <br />Use Permit SCU#05-003 and shall be applicable for an overall development <br />in conjunction with the Development Agreement and CCRs. <br />
