<br />APPEAL TO THE ENFORCING OFFICER'S DECISION <br />A89-009 <br /> <br />Requested by: Mr. Gary W. Davis <br />Mr. Edwin N. Mills <br /> <br />Reqarding: The decision of the Acting Building Official <br />to issue building permit #1431 for the <br />construction of a 2,000 square foot accessory <br />building. <br /> <br />Location: 9910 North Ave. "H" ( See Exhibit A) <br /> <br />Legal Description: West 1/2 of La Porte Outlot No. 487 <br /> <br />Zoninq: R-1, Low Density Residential (See Exhibit B) <br /> <br />Property Owner: Mr. David Couch <br /> <br />Backqround: <br /> <br />The city of La Porte on September 26, 1989, issued building <br />permit #1431 to Mr. David Couch (See Exhibit C). The permit <br />is for the construction of a 2,000 square foot accessory <br />building to be located at Mr. Couch's home, 9901 North Ave. <br />"H". <br /> <br />While this was not the first permit application submitted by <br />Mr. Couch, it should be noted that the Board is only being <br />asked to consider the facts which relate to the issuance of <br />permit #1431. Earlier permit applications are not at issue <br />or revellent to this hearing. <br /> <br />section 10-300.5 of the zoning ordinance states: <br />Larqe Lot Residential Only: Accessory buildings on single <br />family residential large lots may not exceed two thousand <br />(2,000) square feet in floor area, and must be located at <br />least thirty (30) feet from any property line. <br /> <br />Section 3-100 of the Zoning Ordinance defines "single family <br />residential large lots" as follows: <br /> <br />Any single tract or lot comprised of at least 43,550 <br />square feet [one acre] of property, located in a R-l <br />zone, where primary use is for a single family dwelling <br />unit. <br />
