<br />section 10-604.3 states: <br />The Board must find the following in order to grant an appeal: <br /> <br />a. That there is a reasonable difference of interpretation <br />as to the specific intent of the zoning regulations or <br />zoning map, provided the interruption of the enforcement <br />officer is a reasonable presumption and the zoning <br />ordinance is unreasonable. <br /> <br />b. That the resulting interpretation will not grant a <br />special privilege to one property inconsistent with other <br />properties or uses similarly situated. <br /> <br />c. The decision of the Board must be in the best interest <br />of the community and consistent with the spirit and <br />interest of the city's zoning laws and the Comprehensive <br />Plan of the City of La Porte. <br /> <br />Analvsis: <br /> <br />The Couch's property, as indicated by Exhibit A, is comprised <br />of a 2.4290 acre tract of land. Their home (9910 North Ave. <br />"R") is located on this property. The Couch's property <br />therefore qualifies as a "single Family Residential Large Lot" <br />as defined by the zoning Ordinance. <br /> <br />since the property in question qualifies as "large lot", the <br />proposed 2,000 square foot accessory building is an allowable <br />accessory use as per section 10-300.5. <br /> <br />The building is to be located 40 feet from the front property <br />line; 429 feet from the rear property line; 30 feet from the <br />west property line; and 161 feet from the east property line. <br /> <br />Based on the building set backs indicated on Exhibit A, the <br />location of the proposed building satisfies the set back <br />requirements of section 10-300.5. <br /> <br />Conclusion: <br /> <br />Building permit #1431 meets the test of Section 11-604.3. <br />specifically: <br />There is no reasonable difference of interpretation as <br />to the specific intent of the zoning regulations or <br />zoning map, nor are the zoning regulations relating to <br />large lot residential tracts unreasonable. <br />
