• <br />Zoning Board of Adjustment <br />July 24, 2003 <br />#V 03-002 <br />Page 3 of 3 <br /> <br />If acted upon, staff suggest any approvals be subject to review/ approval by: <br />• Army Corp of Engineers for regulations pertaining to Section 10 Waters; and <br />• Texas General Land Office pertaining to lease regulations <br />Conclusion: ~ The request for a reduction of both the standard rear yard setback as well as the standard <br />designated conservation area is unusual. In addition, staff notes that the reductions of <br />these two areas alone does not make the site "buildable". The applicant's other request <br />(special exception) complicates the matter being considered under Variance #V03-002. <br />We suggest that the Board review the next item before taking action on this item. <br />Appeals: As per Section 106-196 of the Code of Ordinances of the City of La Porte: <br />Any person or persons, jointly or severally, aggrieved by any. decision of the Board of <br />Adjustmern, or any taxpayer, or any officer, department, board or bureau of the city may <br />present to a court of record a petition for a writ of certiorari, as provided by V.T.C.A, <br />Local Government Code Section 211.011, duly verified, setting forth that such decision <br />is illegal, in whole or in..part, specifying the grounds of the illegality. Such petition shall <br />be preserned to the court within ten days after the filing of the decision in the office of the <br />. Board of Adjustment. . <br />
