0 . 0 <br />Board of Adjustment <br />January 24, 2002 <br />#V 02-001 <br />Page 3 <br />Screening pr9visions were created to protect (using shrubs and trees to <br />screen) residences and buffer (distance separation) residences from more <br />intense uses, like those found in BI. Generally; these uses involve large <br />trucks delivering, loading and unloading supplies into warehouses. The <br />applicant proposes. only -a 9` wide screen and parking spaces with a <br />maneuvering isle occupying the next 31' of the 40' rear setback. Staff <br />believes this goes against the intent ' of the Zoning Ordinance, and that <br />granting this variance would not be in the public's best interest. <br />Conclusion: The applicant has not shown that circumstances unique to his property exist. <br />Based on the facts outlined in this report, the conditions needed to the grant a <br />variance do not exist. <br />Aupeals: Asper Section 106-196 of the Code of Ordinances of the City of La Porte: <br />Any person or persons, jointly or severally, aggrieved by any decision of the <br />Board of Adjustment, or any taxpayer, or any officer, department,- board or <br />bureau of the city may present to a court of record a petition for a writ of <br />certiorari, as provided by. V T.CA., Local Government Code Section <br />211.011, duly verified, setting forth that such decision is illegal, in whole or <br />in part, -specking the grounds of the, illegality. Such petition shall be <br />presented to the court within ten days after the filing of the decision in the <br />office of the Board of Adjustment <br />
