• • <br />Board of Adjustment <br />September 23, 2004 <br />#SE 04-009 <br />Page 3 of 3 <br />• Portion of the property (a 30' strip leading to S.H. 146) cannot be used <br />for parking since access denied due to narrowness and too close to the <br />adjacent drive. The property will be utilized only for landscaping <br />purpose. <br />• The applicant submits and obtains City approval of a landscape plan that <br />provides large trees and shrubs in the mandatory landscaping of the <br />above strip. An irrigation system is required to ensure that the planting <br />grows and is well maintained. <br />• Identification of the Special Exception information (permit number, date <br />of passage and any conditions) is noted on the minor development site <br />plan. This must be submitted to the City prior to approval and issuance <br />of a building permit. <br />The Board may consider: <br />- Granting the variance and allowing the pazking spaces 9' wide and <br />maneuvering aisle as 27'. <br />- Denying the variance thereby denying the reduction of off-street <br />pazking design standazds. <br />Aaaeals: Asper Section 106-196 of the Code of Ordinances of the City of La Porte: <br />Any person or persons, jointly or severally, aggrieved by any decision of the <br />Board of Adjustment, or any taxpayer, or any officer, department, board or <br />bureau of the city may present to a court of record a petition for a writ of <br />certiorari, as provided by V.T.C.A., Local Government Code Section <br />211.011, duly verified, setting forth that such decision is illegal, in whole or <br />in part, specifying the grounds of the illegality. Such petition shall be <br />presented to the court within ten days after the filing of the decasion in the <br />o,,~ice of the Board ofAdjustment. <br />
