<br />e <br /> <br />e <br /> <br />Minutes, Regular Meeting, La Porte City Council <br />April 27, 1992, Page 2 <br /> <br />TELECOMMUNICATIONS BUSINESS, THE TELEPHONE COMPANY SHALL <br />MAINTAIN AND CONSTRUCT ITS POLES, WIRES, ANCHORS, FIBER, <br />CABLES, MANHOLES, CONDUITS AND OTHER PHYSICAL PLANT AND <br />APPURTENANCES IN, ALONG, ACROSS, ON, OVER, THROUGH, ABOVE AND <br />UNDER ALL PUBLIC STREETS, AVENUES, HIGHWAYS, ALLEYS, <br />SIDEWALKS, BRIDGES OR PUBLIC WAYS IN SAID CITY; PRESCRIBING <br />THE ANNUAL COMPENSATION DUE THE CITY UNDER THIS ORDINANCE; <br />PRESCRIBING THE CONDITIONS GOVERNING THE USE OF PUBLIC RIGHTS- <br />OF-WAY AND THE PERFORMANCE OF CERTAIN CONSTRUCTION WORK ON <br />PUBLIC RIGHTS-OF-WAY FOR THE TELEPHONE COMPANY'S <br />TELECOMMUNICATIONS BUSINESS; PROVIDING AN INDEMNITY CLAUSE; <br />SPECIFYING GOVERNING LAWS; PROVIDING FOR A RELEASE OF ALL <br />CLAIMS UNDER PRIOR ORDINANCES; PROVIDING FOR FUTURE <br />CONTINGENCIES; PROVIDING FOR PUBLIC NOTICE OF THIS ORDINANCE; <br />PROVIDING FOR WRITTEN ACCEPTANCE OF THIS ORDINANCE BY THE <br />TELEPHONE COMPANY; AND PROVIDING FOR A TERM AND AN EFFECTIVE <br />DATE. <br /> <br />Motion was made bv Counciloerson Coooer to ado9t the first <br />readinq of Ordinance 1834 as read bv the city Attornev. <br />Second by Councilperson Clarke. <br /> <br />Motion was made bv Councilperson Porter to amend the motion bv <br />deletinq the first paraqra9h of Section 13 reqarding fixed <br />rates and replace it with an alternative first paragra9h <br />calling for charges for the second and subsequent years of the <br />ordinance be no less than the amount for the first year and <br />that adjustment for qrowth factor be made on the effective <br />anniversary date of the ordinance. Second by Councilperson <br />Skelton. The motion failed with a tie vote of 4 ayes and 4 <br />nays. <br /> <br />Ayes: <br /> <br />Councilpersons McLaughlin, Porter, Skelton and <br />Mayor Malone <br />Councilpersons Sutherland, Cooper, Thrower and <br />Clarke <br /> <br />Nays: <br /> <br />The original motion was voted, and carried, 6 ayes and 2 nays. <br /> <br />Ayes: <br /> <br />Councilpersons Sutherland, Cooper, <br />McLaughlin, Clarke and Mayor Malone <br />Councilpersons Porter and Skelton <br /> <br />Thrower, <br /> <br />Nays: <br /> <br />7. Council considered an ordinance approving and authorizing <br />employment agreement between the City of La Porte and the City <br />Manager of the City of La Porte. <br /> <br />The City Attorney read: ORDINANCE 1835 - AN ORDINANCE <br />APPROVING AND AUTHORIZING AN EMPLOYMENT AGREEMENT BETWEEN THE <br />CITY OF LA PORTE AND THE CITY MANAGER OF THE CITY OF LA PORTE; <br />
