When interpreting and applying the provisions of this chapter, such provisions shall be held to be the minimum requirements, for the promotion of the public health, safety, convenience, comfort, prosperity, and general welfare. (a) Any person, firm or corporation in violation of any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not more than $2,000.00. Each day such violation continues shall constitute a separate offense. (b) In case any building or structure erected, constructed, reconstructed, altered, repaired, converted or maintained, or any building, structure, or land is used in violation of the general law or the terms of this chapter, the city, in addition to imposing the penalty above provided, may institute any appropriate action or proceedings in court to prevent such unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use, to restrain, correct or abate such violation, or to prevent the occupancy of such violation, or to prevent the occupancy of such building, structure or land, to prevent the illegal act, conduct, business or use, in or about such land; and the definition of any violation of the terms of this chapter as a misdemeanor, shall not preclude the city from revoking the civil remedies given it by law in such cases, including collection or reasonable attorney fees and court costs, but same shall be cumulative of and in addition to the penalties prescribed for such violation. DIVISION 1. GENERALLY Subdivision I. - Generally Subdivision II. Planning and Zoning Commission The city planning and zoning commission, created -in accordance with Ordinance No. 681, dated June 17, 1963, of the City of La Porte, and authorized by the city Charter, Section 2.09(e)—Q) and 2.10(c), -shall have the duties and responsibilities of the zoning commission provided for in V.T.C.A., Local Government Code § 211.007.
