<br />. <br /> <br />e <br /> <br />. <br /> <br />'e <br /> <br />e <br /> <br />e <br /> <br />-2- <br /> <br />attached hereto), to a he~ght above the clear zone approach <br /> <br />surface for that approach area (as identified on each individual <br /> <br />map of each said parcel attached hereto), each of said clear zone <br /> <br />approach surfaces being an inclined plane with a slope of 20:1 <br /> <br />(one foot of elevation for each twenty feet of horizontal dis- <br /> <br />tance) located directly above the clear zone approach area, <br /> <br />which inclined plane has, on each of said parcels, an elevation <br /> <br />as shown thereon, at mean sea level, at its inner and lower <br /> <br />edge along line AB, and an elevation, at mean sea level, as <br /> <br /> <br />shown thereon, at its outer and upper edge along line CD, as <br /> <br />shown on each of said separate plats of each of said separate <br /> <br />parcels, as attached hereto; and <br /> <br />WHEREAS, the City Commission of the City of La Porte <br /> <br />does further hereby find" and determine that such aerial naviga- <br /> <br />tion easements over and above the hereinafter described land <br /> <br />shall vest in the City of La Porte, a continuing right and ease- <br /> <br />ment <br /> <br />(I) To take any action necessary to prevent the erection <br />or growth of any structure, tree or other object into <br />the air space above that part of said approach surface <br />which is directly above and over each of said parcels, <br />with the exceptions of Parcels "G" and "K", and to <br />remove from such air space, or mark and light as <br />obstructions to air navigation, any and all structures, <br />trees or other object that may at any time project or <br />extend above the said approach surface; <br /> <br />(2) To prevent any use of the land identified as Parcels "A" <br />through "M", both inclusive, with the exception of said <br />Parcels "G" and "K", which would interfere with the <br />operation and maintenance of the said Airport as a <br />public airport; <br /> <br />(3) To use the air space above the surface of the premises <br />hereinafter described for the flight and passage of <br />aircraft in said airspace, together with the right to <br />cause in said airspace such noise as may be inherent <br />in the operation of aircraft, now known or hereafter <br />used for navigation of or flight in air, using said <br />airspace for" landing at, taking off from, or operating <br />on such airport; . <br /> <br />together with the r~ght of i~gress to, egress from and passage <br />over the land contained within the said clear zone approach <br />
