e - e e e e -3- areas, for such purposes; and WHEREAS, the City Commission of the City of La Porte has found and determined that an aerial nav~gation easement over and above the hereinafter described land is needed and suitable for such purposes, and that it is necessary to acquire said easements for said Airport clear zones, as aforesaid: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY.OF LA PORTE, TEXAS: That the City Attorney of the City of La Porte be, and he is hereby, authorized to negotiate with the owners of such hereinafter described land, for the acquisition of aerial navi- gation easements over the said land, as hereinafter described, at the fair market value for such easements, and should the City Attorney, as the duly authorized representative of the City of La Porte, be unable to agree with such owners as to the fair market value of such easements, then, and in that event, the City Attorney of the City of La Porte be, and he is hereby, authorized and directed to file against all owners and lien holders, proceedings in eminent domain to acquire aerial naviga- tion and clear zone easements, over the tracts hereinafter described by metes and bounds, and as shown on the plat of each of said tracts attached hereto, incorporated by reference herein, and made a part hereof for all purposes: TRACT "A": BEGINNING for reference at a 1/2". iron pipe found for the Southwest corner of the La Porte Municipal Airport, said point being in the North right-of-way line of Spencer Highway; THENCE N89034'25"W a distance of 14.50 feet to a point in the North right-of-way line of Spencer Highway; THENCE S37005'17"E a distance of 126.96 feet to a point in the South right-of-way line of Spencer Highway, said point being the PLACE OF "BEGINNING for Tract "A"; THENCE S89"34'25"E a distance of 155.28 feet along the South right-of-way line of Spencer Highway to a point for corner in the South right-of-way line of Spencer Highway; THENCE S47012'05"W a distance of 123.78 feet to a point for corner; THENCE N37005'17"W a distance of 106.87 feet, the POINT OF BEGINNING of said Tract "A", said tract containing 0.2177 acres of land.
