<br />2. Fences: Swimming pools, spas, and hot tubs shall be enclosed <br />within a fence at least four feet (4') in height. Fences <br />shall comply with all requirements of the currently adopted <br />edition of the Standard Swimming Pool Code published by the <br />Southern Building Code Congress International. In the case <br />of a pool located in a front yard adjacent to the shoreline <br />of Galveston Bay, see Section 10-502. <br /> <br />Section 10 - 400 Exceptions <br /> <br />10 - 401 Yard Requirements <br /> <br />The following shall not be considered as encroachments on yard <br />setback requirements. <br /> <br />1. Chimneys, flues, belt courses, leaders, sills, pilasters, <br />lintels, ornamental features, cornices, eaves, gutters, steps, <br />stoops, and the like, provided they do not project more than <br />four feet (4') into any front or rear yard, and two feet (2') <br />into any side yard. <br /> <br />2. Terraces, decks, patios, or similar features, provided they <br />do not extend more than one foot (1') above the height of the <br />exterior finish grade elevation, or to a distance less than <br />two feet (2') from any lot line, or encroach upon any utility <br />easement. Further, pools shall not be considered as an <br />encroachment on a front yard setback, provided that said pools <br />are located in a front yard adjacent to Galveston Bay, and <br />provided further that said pool does not extend more than one <br />foot (1') above the exterior finish grade elevation, or to a <br />distance less than two feet (2') from any lot line or encroach <br />upon any utility easement. <br /> <br />EXH\Btf D <br />
