ORDINANCE NO. liS 2- AN ORDINANCE REPEALING CHAPTER 10 1/2 OF THE CODE OF ORDINANCES OF THE CITY OF LA PORI'E, TEXAS, ENTITLED " FLOOD HAZARD AREA REGULATIONS", AND REPLACING SAID CHAPTER 10 1/2 BY ENACTING A NEW ORDINANCE, ENTITLED "FLOOD DAMAGE PREVENTION ORDINANCE"; MAKING FINDINGS OF FACT AND RECITING STATU'IORY AUTHORIZATION FOR SAID NEW CHAPTER 10 1/2, AND MAKING A STATEMENT OF THE PURPOSES OF SAME; PRO- VIDING CERI'AIN DEFINITIONS; ESTABLISHING THE LAND WITHIN THE CITY OF LA PORI'E 'IO WHICH THIS ORDINANCE APPLIES, AND THE BASIS FOR WHICH SAID LANDS WERE DETER- MINED; PROVIDING FOR A FLOOD PLAIN BUILDING PERMIT; PROVIDING THAT NO STRUCTURE OR lAND SHALL BE IDCATED, ALTERED, OR HAVE I'IS USE CHANGED WITHOUT FULL OOM- PLIANCE WITH nus ORDINANCE; PROVIDING FOR THE DESIGNATION OF A FLOOD PLAIN ADMINISTRA'IOR FOR THE CITY OF LA PORI'E, 'ID .AIl-1:INISTER THIS ORDINANCE AND PERMIT PROCEOORES; PROVIDING FOR A VARIANCE PROCEDURE, 'ID BE AI:MINISTERED BY THE PLANNING AND ZONING COMMISSIOO OF THE CITY OF LA PORTE; PROVIDING GENERAL AND SPECIFIC STANDARDS FOR FlOOD PLAIN HAZARD REDUcrIOO, AND STANmRDS FOR AREAS OF SHALLOW FlOODING; PROVIDING STAND.ARI:S FOR DEVEIDPMENT PROPOSAlS WITHIN THE CITY OF LA PORTE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING A SEVERABILITY ClAUSE; PROVIDING A PENAL CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF; WHEREAS, the legislature of the State of 'lexas has in Article 8280-13, V. T. C. S., as anended, delegated the responsibility to local governmental units to adopt regulations designed to minimize flood losses; and WHEREAS, flood hazard areas of the City of La Porte are subject to periodic inundation which results in loss of life and property, health and safety hazards, disruption of camnarce and governmental services, and extraordinary public expendi- tures for flood protection and relief, all of which adversely affect the public health, safety and general ~lfare; and WHEREAS, these flood losses are created by the cumulative effect of 00- structions in flood plains which cause an increase in flood heights and velocities, and by the occupancy of flood hazards areas by uses vulnerable to floods and hazar- dous to other lands because they are inadequately elevated, floodproofed, or other- wise protected from flood damage; and WHEREAS, the City Council of the City of La Porte deems it necessary in order to pranote the public health, safety and general ~lfare and to minimize public and private losses due to flood conditions in specific areas by provision designed to: To protect human life and health; To minimize expenditure of public money for costly flood control projects; To minimize the need for rescue and relief efforts associated with flooding and generally undertaken at the expense of the general public;
