<br />Corporation, hereinafter referred to as! "Declarant"', to place restrictions,
<br />covenants, conditions, stipulations an~ reservations upon all of said
<br />property in said Creekmont Subdivision,1 Section One, NOW, THEREFORE,
<br />Declarant, does hereby adopt, establish and impose the following
<br />res,trictions, covenants, reservations and condi tioJ;ls upon all lots, as
<br />defined herein, which shall consti tut~ covenants running with the
<br />ti tIe of said lots and which shall be \ bindfng upon ~d inu~e to the
<br />benefit'of Declarant, its su~cessors, and each and ail of such

<br />ARTICLE I \
<br />
<br />DEFINITIONS ~
<br />
<br />Section 1: "Properties" shall mean and refer to all land in
<br />Creekmont Subdivision, Section I, which is subj ect to the matters set
<br />forthherein and in the Subdivision Plat, and any additional land made
<br />subj ect to the tt;lI1DS hereof pursuant to the provisions set forth herein.

<br />Section, 2: The words "lot" or "lots" shall mean or refer to
<br />. any plot of land sl:).own upon the Subdivision Plat, with the exception of
<br />. ' (a) any portion of the Properties wh:i,.ch is or may be hereafter designated
<br />or described on the Subdivison Plat as "Not Platted" or "Reserved" or
<br />with words of similar meaning, and (b) land described in Exhibit "A", if
<br />any, attached hereto and made a part hereof.

<br />Section 3: "Declarant" ;slt-all mean and refer to the Beau-Bay
<br />Development Corporation or its sucfessors.
<br />
<br />Section 4: "Owner" shall mean and refer to the record owner,
<br />whether one or more persons or entities,' of fee simple title to aqy lot
<br />which is part of the Properties, including contract sellers, but
<br />excluding those whose interest is held merely as security for the
<br />perfonnance of an obligation.
<br />
<br />Section 5: "Subdivision Plat" shall mean and refer to the
<br />map or plat of Creekmont Subdivision, Section I, of record as hereinabove
<br />mentioned, or as such plat may be amended.
