<br />ORDINANCE No !68.
<br />
<br />An Ordinance, establishing a standard of Weights and Measures
<br />for the City of La Porte, providing for the office of a Sealer of
<br />weights and measures,for his appointment and qualification for the
<br />appointment of deputies, prescribing powers, duties and compensa-
<br />tion, and prOViding for a penalty. '
<br />
<br />Be it ordained by the City Council of the City of La Porte:-
<br />
<br />Section 1.; There is hereby created the department of weights and
<br />Measures of the City of La Porte; such department shall 'be in charge
<br />of and under control of an Officer to be known as the Sealer of
<br />Weights and Measures of the City of La Porte, who shall be appoint-
<br />ed by the Mayor, by and with the consent of the majority of the
<br />City Council. He shall hold his office for the term of One Year,
<br />or until the first UOllday in April following' his appointment, and
<br />until his successor is elevteo and qualified.
<br />Before entering upon the discharge of the duties of his office
<br />he ,Shall take the Constitutioaal Oath of office, and execute such
<br />bOIlld as may be prescribed by the Oi ty Council of the City of La-
<br />Por'te. Hi s compnllation, and the payment thereof shall be fixed by
<br />the Mayor and ,City Council.

<br />Section 2. There may be appointed such Oeputy Sea)ers of weights
<br />and~ measures, as the Mayor may deem expedient, who shall take the
<br />sante oath and give the same bond as is reqUired of the Sealer.

<br />SectioD 3. The ~ealer of Weights and Measures may procure a com-
<br />petent set of accurate weights and ~easures of the ~tate of Texas,
<br />,.'Whun so directed by the City Council and cause the same to be trie4
<br />l prc)ved, sealed and certified to by the official Custodian of Weights
<br />/~ and Measures of the S~ate of Texas; 'and thereby such weights and '
<br />" measures shall be for the City of La Porte, and all vendors therel~
<br />,i ThE~ Sealer shall be the custodian of such standard set of weights
<br />ancl measures when so procured, and the same shall at all times con-
<br />fOJ~m ,to the standard of weights and measureS prescribed by law. The
<br />Selller shall prescribe the amount of tolerance to be allowed on
<br />weights and measures.

<br />Section 4., It shall be the duty of the Sealer of weights and mea
<br />SUlres to visit, form time to time as may be necessary, all places
<br />in said City where weights or scales of any kind or character are
<br />used, and to inspect the same, and for that purpose it shall be law-
<br />ful for him, and he is empowered at any respectable hour to enter ap
<br />an'Y' store-house or oth~r building where any such, weightS or scales

<br />or measures' are used;: such Bealer shall have supervision and control
<br />of all matters relating to measures and scales thereby, and he is
<br />charged with the enforcement or all Laws and Ordinances relating
<br />thereto. '

<br />gection 5. Whero any duty 1s placed upon the Sealer of Weights
<br />and ~!easures'under any Ordinance of the City of La Porte, the same
<br />may b~ performed by a duly appointed and qualified neputy, who shall
<br />in. the performance of his duties, have all the power of the Sealer.
<br />
<br />, ~ection 6. It shall be the duty of said'~ealer of Weights and
<br />Meiasures, not less than once in each year, and as much as may in his
<br />j'\Jldgment be necessary, to inspect and test the accuracy of all
<br />.'Iights, measures, s~ales, scal~beams, balances, steelyards, automa-
<br />ti,c and computing scalas, and all other instruments used in weighing
<br />arlY article Intendedto be sold or purchased in said City, and to
<br />stamp with a suitable seal, or otherwise certify as to the accuracy
<br />ccmforming tq the City standard, and deliver to the owner thereof a
<br />cortificate of such accuracy; and shall keep a register or all such
<br />WE)ights, meaSures 8cc., certified, and of all certificates issued,
<br />aud to whom.
