<br />'. <br /> <br />. <br /> <br />ORDINANCE NO. 705-F <br /> <br />.'. <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 705 (AN ORDINANCE PROVIDING <br />RULES AND REGULATIONS GOVERNING THE PLATTING OR RE-PLATTING OF <br />LAND IN THE SUBDIVISIONS IN THE CITY OF LA PORTE AND WITHIN THE <br />EXTRATERRITORIAL JURISDICTION OF THE CITY OF LA PORTE); AND <br />PROVIDING THAT ANY' PERSON VIOLATING THE TERMS OF THIS ORDINANCE <br />SHALL BE DEEMED. GUILTY OF A MISDEMEANOR AND UPON CONVICTION <br />SHALt BE FINED IN ANY SUM NOT LESS THAN TEN DOLLARS ($10.00) NOR <br />MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION <br />SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING AN EFFECTIVE <br />DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />-Section 1. Section 4.03, of City of La Porte Ordinance <br />No. 70S, is hereby amended by adding thereto a Sub-paragraph 11, <br /> <br />as follows, to-wit: <br /> <br />.. <br /> <br />"11. If any part. of this plat lies in a flood hazard <br />area, then one-foot contour lines shall be shown <br />on the'plat and the 100-year flood elevation con- <br />tour shall be drawn with a very heavy line and <br />designated. The plat shall also show the <br />following statement in print equal in size to the <br />certificates of approval: 'Parts of this plat <br />lower than the 100-year flood elevation have a <br />one percent (1%) chance each year of being <br />inundated by flooding.'" <br /> <br />Section 2. Section 11 of City of La Porte Ordinance <br /> <br />No. 705, is hereby amended by adding thereto a Sub-paragraph <br /> <br />II. 06, "E'lood. Pron~ Areas," as follows, to-wit: <br /> <br />"11.06 FLOOD PRONE AREAS. <br /> <br />(a) Definitions. <br /> <br />-. <br /> <br />(1) Flood prone area. The term 'flood prone <br />area' shall mean any area which can reasonably <br />be expected to be subject to periodic flooding. <br /> <br />(2) 100-year flood. The term 'lOO-year <br />flood' shall mean a flood of such magnitude as <br />may, reasonably be expected to be equaled or <br />exqeeded on an average of once every 100 years; <br />the term also means that level of flooding having <br />one percent (1%) probability of occurrence each <br />year. <br /> <br />(b) Flood Prone Area Requirements. <br /> <br />(1) Development of flood prone areas is <br />prohibited except as permitted by this ordinance <br />and the Flood Hazard Area Regulations Ordinance. <br /> <br />. (2) Subdivision of flood prone areas is <br />prohibited where the cost of providing utilities <br />and governmental services would pose an unreason- <br />able economic burden. <br /> <br />-. <br /> <br />(3) The location, elevation, and construction <br />of all' utilities and facilities, such as sewer, <br />gas, electrical and water systems and streets shall <br />be in such manner as to minimize or eliminate <br />damage by flooding. <br />
