<br />e <br /> <br />e <br /> <br />actions taken by the Grantee in response thereto; <br /> <br />(viii) compliance with the FCC customer service standards; and/or <br /> <br />(ix) a statement as to whether there has been any substantial change from <br /> <br />information or plans previously provided to the City. <br /> <br />C. At any such hearing, the Grantee shall be entitled to all the rights of due <br /> <br />process consistent with the City procedures, including but not limited to, the right to present <br /> <br />evidence and the right to be represented by counsel. <br /> <br />D. Unless specifically waived by the City Council, attendance of the Grantee's <br /> <br />duly authorized representative at these public hearings shall be mandatory. <br /> <br />E. City Council shall hear any interested Persons during such hearings and <br /> <br />shall determine whether Grantee did reasonably comply with the terms and conditions imposed by <br /> <br />this Franchise. <br /> <br />F. All records and minutes of each of the performance evaluation hearings shall <br /> <br /> <br />be retained by the City Secretary and be available for inspection throughout the term of the <br /> <br /> <br />Franchise. <br /> <br />G. Following any public hearing, Grantee shall make available to the City <br /> <br />within thirty days of a written request, any additional records, documents, or other information as <br /> <br /> <br />may be reasonably relevant to the City Council's review of Grantee's compliance with this <br /> <br /> <br />Franchise. <br /> <br />H. This section shall not be construed as limiting the City's right to monitor the <br />Grantee's compliance with the terms of this Franchise at all times during the term of the Franchise <br />and to hold public hearings or take any other steps it deems appropriate. <br />Section 8.
