<br />(b) A person subject to the requirements of subsection (a) of this section commits an offense <br />if the person fails to submit a copy of the NOT to the city. <br /> <br />Sec. 34-284. Compliance with permit. <br /> <br />(a) A facility that has storm water discharges associated with construction activity shall be <br />operated in strict compliance with the requirements of its NPDES or TPDES permit to <br />discharge storm water associated with construction activity. <br /> <br />(b) The storm water pollution prevention plan implemented to satisfy the requirements of an <br />NPDES or TPDES permit to discharge storm water associated with construction activity <br />shall comply with the storm water management handbook for construction activities. <br /> <br />(c) A person commits an offense if the person operates a facility that has storm water <br />discharges associated with construction activity in violation of the facility's NPDES or <br />TPDES permit to discharge storm water associated with construction activity. <br /> <br />Sec. 34-285. Modification of storm water pollution prevention plans. <br /> <br />(a) The city engineer and the building official may require the operator of a facility that has <br />storm water discharges associated with construction activity to modify the facility's storm <br />water pollution prevention plan if, in the best professional judgment of the city engineer <br />or the building official, the storm water pollution prevention plan does not comply with <br />the requirements of the facility's NPDES or TPDES permit to discharge storm water <br />associated with construction activity. <br /> <br />(b) Notification of the deficiencies in a facility's storm water pollution prevention plan shall <br />be made in writing, and the facility operator will be given a reasonable amount of time, <br />not to exceed 30 days, to make the necessary changes in the storm water pollution <br />prevention plan. <br /> <br />Sees. 34-286--34-289. Storm Water Discharges Associated With Industrial Activity <br /> <br />Sec. 34-290. Unpermitted discharges prohibited. <br /> <br />(a) A person who is the owner or the operator of a facility that has storm water discharges <br />associated with industrial activity commits an offense if the person discharges, causes to be <br />discharged, or threatens to discharge storm water associated with industrial activity without <br />having first obtained an NPDES or TPDES permit to do so. <br /> <br />25 <br />
