The scenario is as you recently <br /> described it to me Mayor Rigby - earlier this year a representative from <br /> HC approached you and stated that the county may be interested in <br /> giving SB Park to the City of La Porte (This was confirmed by Dave <br /> Waldren, Pcnt 2 Chief of Staff to the Commissioner). If that were to <br /> occur, then the city of La Porte could use the $4 -5M you also mentioned <br /> as earmarked for a `pavilion project' to damage or destroy the building <br /> w/o any historical review or consequence. SAL will prevent this from <br /> happening as any funds from any source could not be used without an <br /> antiquities permit. <br /> Restoration Project: <br /> • As the project will use federal HUD CDBG funds, the restoration must <br /> follow the US Dept of Interior Section 106 guidelines for its conduct and <br /> must be reviewed and approved by the THC staff. <br /> • The SAL would require an antiquities permit that follows the same US . <br /> Dept of Interior Section 106: guidelines, and as mentioned in the THC <br /> letter, can be performed co- currently with the NHR approval as the same <br /> individual does both permits — so no project delay will occur. _ As the <br /> THC deemed the SBP SAL eligible, the project must progress under an <br /> antiquities permit until the historical commissioners rule otherwise. <br /> • Regarding site archeology any antiquities found on all public properties <br /> whether or not they are listed as NHR or SAL, are afforded protection <br /> under the state antiquities code. So if an arrowhead or bone fragment <br /> were found during any earth movement or trenching, an investigation <br /> would be triggered whether it is an SAL or not. However, as this is not <br /> a virgin site but rather was a major construction site 54 years ago and <br /> has been inundated by storm surge several times since, there is little <br /> chance that any antiquities will be found at this site. <br />
