<br />e <br /> <br />e <br /> <br />or removal shall be liable for any damages to the surface of <br />said Utility Easements Tract or any building or improvements <br />permitted adjacent to the Utility Easement Tract resulting from <br />any such work. <br />VII. Septic Tanks and Sanitary Sewer Easements <br />A. The Owner of Parcel 1 intends to construct on Parcel 1 <br />septic tanks and related sewer line or lines. Said septic <br />tanks shall be built on that portion of Parcel 1 described on <br />Exhibit I attached hereto and made a part hereof (hereafter <br />referred to for purposes of this Section VII as the "Septic <br />Tank and Sanitary Sewer Easement Tract"). <br />B. The Owner of Parcel 1 shall initially pay all costs <br />and expenses of constructing the septic tanks and related sewer <br />lines located on Parcel 1. Subject to the provisions of <br />Sections IX and XI hereof, the Owner of Parcel 2 and the Owner <br />of Parcel 3 severally agree, within ten (10) days after request <br />therefor by the Owner of Parcel 1, to each reimburse the Owner <br />of Parcel 1 for all the costs and out-of-pocket expenses of <br />such construction and installation, in an amount equal to such <br />costs and expenses multiplied by a ratio the numerator of which <br />is the number of square feet of improvements on the subject <br />parcel and the denominator of which is the sum of the number of <br />square feet of improvements on Parcels 1, 2 and 3. Each time <br />improvements are added to Parcel 2 or Pa'rcel 3, an additional <br />sum, calculated on the same formula, but deducting therefrom <br />any amounts previously paid, shall be payable to the Owner of <br />Parcel 1; provided however, if the Owner of Parcel 1 undertakes <br />to construct and install sewer lines on Parcels 2 and 3, reim- <br />bursement for said construction and installation on Parcels 2 <br />and 3 shall be equal to one hundred percent of such cost and <br />expenses. <br />C. The Owner of Parcel 1 hereby grants a non-exclusive, <br />perpetual easement to the Owner of Parcel 2 and the Owner of <br /> <br />-11- <br />
