PlanningandZoningCommissionRegularMeeting <br />August21,2014 <br />Chapter106ProposedRevisions <br />whichareinredfont. <br />Firstofall,therehasbeenarequestbymultifamilydeveloperstoallowforotherforms <br />ofassurancesratherthanbondsorirrevocablelettersofcredit.Languagehasbeen <br />addedallowingforconsiderationofotherassurancesifapprovedbythePlanningand <br />ZoningCommission.Thisproposedmodificationhasbeenmadetosubsection(a). <br />Additionallysubsection(b)wasmodifiedtoclarifythestandardsforwhichthis <br />assurancecouldbepulled,includingmaintainingͻƷŷĻhealth,safetyandwelfareofthe <br />tenantsandtheintegrityofthesurroundingƓĻźŭŷĬƚƩŷƚƚķ͵ͼ <br />SitePlans(ArticleII,Division8): <br />8.Section106268,Nonconforminglotsofrecord,describesrequirementsforthoselotsof <br />recordthatarenonconformingandrequirementsforthoselots,includingbringingthose <br />propertiesintocompliancewiththecode.Thisisoneissuethatstaffpartiallydisagrees <br />withtherecommendedmodificationsoftheSubcommittee. <br />Subsection(a)currentlyrequiresanyͻƓĻǞuseorchangeinƚĭĭǒƦğƓĭǤͼbesubjectto <br />reviewbythePlanningDirectorincludingreviewofparking,loading,vehicularaccess, <br />landscaping,setbacks,utilityavailability,andotherrequirements.TheSubcommitteeis <br />recommendingthatthephaseͻƚƩchangeinƚĭĭǒƦğƓĭǤͼbestrickenfromthis <br />subsection.Thiswouldpreventthecityfromrequiringthosenonconforminglotsof <br />recordtocomeintocompliancewiththecodeandwouldallowthemtoremain <br />nonconforminguntilsuchtimeasanewuseisproposedonthesite.Staffissupportive <br />ofthismodification. <br />However,staffismoreconcernedwithstrikingouttheworkͻĬǒƷƓƚƷͼfromthelast <br />sentenceofthefirstparagraphofsubsection(a).Thisprovidesstaffwiththe <br />opportunitytoincrementallybringnonconformitiesclosertocompliancewiththecode <br />whenthereisachangeinuseandisnotnecessarilylimitedtothelistofitemsthat <br />follows.The{ǒĬĭƚƒƒźƷƷĻĻƭrecommendationistostrikeͻĬǒƷƓƚƷͼandreplacewith <br />ͻğƓķͼͲwhichwouldlimitwhatstaffcouldattempttobringintocompliancewiththe <br />codewhenanonconforminglotofrecorduseischanged.Staffwouldbelimitedtoonly <br />thatlistofitems.Staffbelievesthereareothercodeprovisionsthatmightbeapplicable <br />onacasebycasebasisthatcouldincludeitemssuchassurfacepavingforparkinglots <br />andotherthingsaswell. <br />StaffisrecommendingthatthewordsͻĬǒƷƓƚƷͼnotbestrickenfromthedocument. <br />Section106310,CommercialandIndustrialUsesTable: <br />9.Asameanstoimproveaccesstoinformationforthosedevelopingbusinesses,the <br />Subcommitteeisrecommendingcombiningboththecommercialandindustriallanduse <br />tables(Sections106441and106521,respectively)andrelocatingthemtoanew <br />Section106310. <br />Inthecurrentversionofthecode,landusesintheCityofLaPortewerecategorized <br />throughtheStandardIndustryClassification(SIC)systemandtheindustrynumber <br />3 <br /> <br />
