<br />Section 6 Insurance requirements. <br /> <br />. <br /> <br />(a) No ambulance license shall be issued under this chapter, nor shall such license be <br />valid after issuance, nor shall any ambulance be operated for any reason in the city, <br />unless there is at all times in force and effect insurance coverage. issued by an <br />insurance company licensed to do business in the State of Texas. for each and every <br />ambulance owned and/or operated by or for the applicant for license providing for <br />the payment of damages: <br />(1) For injury to or death of individuals in accident resulting from any cause for <br />which the owner of said vehicle would be liable on account of liability imposed <br />on him by law, regardless of whether the ambulance was being driven by the <br />owner or his agent. <br />(2) For the loss of or damages to the property of another, including personal <br />property, under like circumstances, in the following sums: Not less than one <br />hundred thousand dollars ($100,000.00) for each person, three hundred thousand <br />dollars ($300,000.00) for each accident and ten thousand dollars ($10,000.00) for <br />property damage. A written statement from an authorized agent of the <br />ambulance oJXfrator's insurance carrier verifying the issuance of such insurance <br />shall be filed with the chief EMS officer before any pennit may be issued. All <br />such verifications of insurance coverage shall provide for a thirty-day <br />cancellation notice to the chief EMS officer. <br />(3) Every insurance policy required hereunder shall contain a provision foe a <br />continuing liability thereunder to the full amount thereof not withstanding any <br />recovery thereon, that the liability of the insurer shall not be affected by the <br />insolvency or the bankruptcy of the assured, in that until the policy is revoked the <br />insurance company will not be relieved from liability on account of nonpayment <br />of premium, failure to renew license at the end of the year, or any act or <br />admission of the named assured. Such policy of insurance shall be further <br />conditioned for the payment of any judgements up to the limits of said policy, <br />recovered against any person other than the owner, by his agent or employee, <br />who may operate the same with the consent or acquiescence of the owner. <br /> <br />. <br /> <br />(b) Each attendant involved in the operation of an ambulance within the city limits shall <br />be required at all times to be covered by a professional liability insurance policy. <br />This policy may be provided by the applicant company for all its employees or <br />individual policies issued to all personnel employed by the company. <br /> <br />(1) This coverage must be from an insurance company licensed to do business in the <br />State of Texas for each and every person operating in the City of La Porte. <br />(2) The limits of liability required are no less than five hundred thousand dollars <br />($500,000.00) per claim and a one million-dollar ($1,000,000.00) aggregate <br />umbrella policy_ <br />(3) It shall be the responsibility of each applicant company or individual to provide <br />proof of such policy to the chief EMS officer. <br />(4) Failure to provide such proof will be justification to suspend and/or not issue any <br />attendant, driver and/or ambulance permit. <br /> <br />. <br />
