Motion was made by Councilman Tomerlin to pass and approve Ordinance No. 1242, closing that portion of Texas Avenue between the south right-of-way line of South K Street and the north right-of-way line of South L Street and lying and being situated between Blocks 1120 and 1122 but retaining a 16 foot easement as discussed. The motion was seconded by Councilman Kibodeaux. The motion carried, 4 ayes and 0 nays. Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman Cline, Councilman Simons Nays: None 12. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK ELEVEN HUNDRED TWENTY- TWO (1122) , IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. Motion was made by Councilwoman Cline to pass and approve Ordinance No. 1243, vacating the alley in Block 1122 for Roy Kaylor. Seconded by Councilman Simons. The motion carried, 4 ayes and 0 nays. . Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman Cline, Councilman Simons Nays: None 13. City Attorney Askins read: AN ORDINANCE AMENDING CHAPTER 25, SECTION 33, OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, DEFINING AND CREATING THE OFFENSE OF NEGLIGENT COLLISION; PROVIDING THAT PROOF OF NO INTENT SHALL NOT BE REQUIRED; CON- TAINING EXCEPTIONS; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDE- MEANOR AND SHALL UPON CONVICTION BE FINED NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) ; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilwoman Cline to adopt Ordinance No. 1244 as read by the City Attorney. Seconded by Councilman Simons. The motion carried, 4 ayes and 0 nays. Council considered a request by Dan Tarpey of 620 South Lobit, to make a trailer van a part of a permanent structure at this address. Attached to these minutes are memos concerning this request from Planning and Zoning and Code Enforcement. Council discussed this structure at length. Cline stated she felt . the only way to clean this matter up was to grant the variance and require the builder to comply with all City codes.
