Council considered adopting the zoning ordinance text. <br /> <br />Motion was made bv Councilperson Matuszak to amend 10-S02 of <br />the ordinance. Second by Councilperson Lloyd. The motion <br />carried, 5 ayes and 0 nays. <br /> <br />Ayes: Councilpersons Lloyd, Matuszak, Porter, Pfeiffer, Gay <br />and Mayor Malone <br />Nays: None <br /> <br />The City Attorney read: ORDINANCE 1501 - AN ORDINANCE <br />CONTAINING FINDINGS OF FACT AND DIRECTIVES TO THE PLANNING <br />COMMISSIONj AND ADOPTING A NEW ZONING ORDINANCE FOR THE CITY <br />OF LA PORTE, SAID NEW ZONING ORDINANCE TO REGULATE: THE <br />LOCATION AND USES OF BUILDINGS, STRUCTURES, LAND, LOTS, AND <br />USES AS DEFINEDj THE HEIGHT AND SIZE OF BUILDINGS, STRUCTURES, <br />AND USES BOTH PRIMARY AND ACCESSORYj THE DENSITY AND INTENSITY <br />OF POPULATION AND USES, BOTH PRIMARY AND ACCESSORYj THE SIZE <br />AND LOCATION OF YARDS, SETBACKS, CONSERVATION AREAS, AND OPEN <br />SPACESj THE LOCATION AND DENSITY OF PARKING, LOADING, EXTERIOR <br />STORAGE, FENCING, AND LANDSCAPING; PROVIDING FOR PLANNED UNIT <br />DEVELOPMENTSj PROVIDING A SPECIAL CONDITIONAL USE PROCEDURE; <br />RE-ESTABLISHING A PLANNING AND ZONING COMMISSION AND A BOARD <br />OF ADJUSTMENTj AND PROVIDING FOR THE ADMINISTRATION AND <br />ENFORCEMENT OF THIS ORDINANCEj FOR SAID PURPOSES DIVIDING THE <br />MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER AND AREA AS MAY BE <br />DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONSj PROVIDING <br />THAT ANY PERSON, FIRM, OR CORPORATION VIOLATING ANY OF THE <br />TERMS OR PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY <br />OF A MISDEMEANOR, AND UPON CONVICTION SHALL BE LIABLE TO FINE <br />NOT THE EXCEED ONE THOUSAND DOLLARS ($1,000.00); WITH EACH DAY <br />OF VIOLATION CONSTITUTING A SEPARATE OFFENSEj PROVIDING A <br />SAVINGS CLAUSEj PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR <br />THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN <br />CONFLICT WITH THE PROVISIONS HEREOF AS OF THE EFFECTIVE DATE <br />OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />Motion was made bv Councilperson Matuszak to adopt Ordinance <br />1S01 as amended. Second by Councilperson Lloyd. The motion <br />carried, 6 ayes and 0 nays. <br />
