Council considered an ordinance granting a wine and beer on <br />premise permit for Longhorn Lounge. <br />The City Attorney read: ORDINANCE 1000-AA - AN ORDINANCE <br />AMENDING ORDINANCE NO. 1000 OF THE CITY OF LA PORTE, TEXAS, <br />DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON THE <br />PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE; <br />PROVIDING FOR HOURS OF OPENING AND CLOSING; PROVIDING SALE OF <br />BEER FOR CONSUMPTION OFF PREMISES SHALL NOT BE AFFECTED; <br />DEFINING SOURCE OF AUTHORITY; PROVIDING A SAVINGS CLAUSE; <br />PROVIDING THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR THE AREA <br />HEREIN DESIGNATED; FINDING COMPLIANCE WITH THE OPEN MEETINGS <br />LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />Motion was made by Councilperson Cooper to adopt Ordinance <br />1000-AA as read by the City Attorney. Second by Councilperson <br />Clarke. <br />After discussion of whether or not the establishment met the <br />criteria set forth in Ordinance 1000 regarding the sale of <br />food in conjunction with on premise sale of wine and beer, <br />motion was made by Councilperson McLaughlin to table this <br />Ordinance for further clarification. Second by Councilperson <br />Skelton. The motion carried, 5 ayes and 3 nays. <br />Ayes: Councilpersons McLaughlin, Porter, Skelton, Clarke <br />and Mayor Malone <br />Nays: Councilpersons Cooper, Gay and Sutherland <br />The Mayor asked that this item be taken to executive session. <br />It was the City Attorney's opinion that there was no proper <br />subject to do so. The Mayor then stated that since there was <br />a workshop scheduled for February 4, to take it to workshop. <br />10. Council considered approving a proposal from Don Graesser to <br />provide design, construction, and inspection phase services <br />for repainting of Bayshore elevated water storage tank, and <br />inspection phase services for painting new Northwest elevated <br />water storage tank. <br />Motion was made by Councilperson Skelton to approve the <br />proposal from Don Graesser. Second by Councilperson Cooper. <br />The motion carried, 7 ayes and 1 nay. <br />Ayes: Councilpersons Sutherland, Cooper, McLaughlin, Gay, <br />Skelton, Clarke and Mayor Malone <br />Nays: Councilperson Porter <br />
