Second by Councilperson <br />Clarke. The motion carried, 8 ayes and 0 nays. <br />Ayes: Councilpersons Sutherland, Cooper, Thrower, <br />McLaughlin, Porter, Maxwell, Clarke and Mayor <br />Malone <br />Nays: None <br />6. Council considered an ordinance amending the Code of <br />Ordinances of the City of La Porte, by adding a new Article IV <br />to Chapter 13, relating to the establishment of a daytime and <br />night time juvenile curfew. <br />The City Attorney read: ORDINANCE 1887 - AN ORDINANCE <br />AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, <br />TEXAS, BY ADDING A NEW ARTICLE IV TO CHAPTER 13, RELATING TO <br />THE ESTABLISHMENT OF A DAYTIME AND NIGHT TIME JUVENILE CURFEW; <br />CONTAINING FINDINGS AND OTHER PROVISIONS RELATING TO THE <br />FOREGOING SUBJECT; DECLARING CERTAIN CONDUCT TO BE UNLAWFUL <br />AND PROVIDING PENALTIES THEREFOR; PROVIDING FOR SEVERABILITY; <br />PROVIDING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />City Manager Bob Herrera stated that at the last Council <br />meeting this proposed ordinance was workshopped and there was <br />some discussion as to what constitutes an adult and what age <br />this ordinance would be in effect. <br />Chief Powell explained that the school attendance law says if <br />you are 16 when you start the school year, then you must <br />finish that year. If you turn 16 before school starts the <br />first semester, you don't have to attend. However, a person <br />can leave home at 17 you cannot consider them runaways, but if <br />that 17 year old is injured, parental consent is needed to <br />treat. So it's up to Council what age they want in the <br />ordinance. <br />After discussion by Council regarding the daytime portion of <br />the curfew and counseling services available, motion was made <br />by Councilperson Maxwell to table the ordinance for further <br />refinement. The motion died for lack of a second. <br />Motion was made by Councilperson Porter to adopt Ordinance 93- <br />1887 as read by the City Attorney. Second by Councilperson <br />Thrower. The motion carried, 7 ayes and 1 nay. <br />
