Council considered approving request of Houston Shell & <br />Concrete for Special Conditional Use permit # SCU93-001. <br />Motion was made by Councilperson Gay to approve the special <br />Conditional Use permit for Houston Shell & Concrete. Second <br />by Councilperson McLaughlin. Workshop Item: Discuss amendments to juvenile curfew <br />ordinance. <br />Discussion was held by Council on proposed amendments to the <br />juvenile curfew ordinance, which were (1) change the <br />definition of minor to mean any person under seventeen (17) <br />years of age; and to delete item 2, daytime curfew, from <br />Section 13.52(a). <br />9. Council considered an ordinance amending Ordinance 93-1887 <br />addressing juvenile curfew. <br />The City Attorney read: ORDINANCE 93-1887-A - AN ORDINANCE <br />AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, <br />TEXAS, BY ADDING A NEW ARTICLE IV TO CHAPTER 13, RELATING TO <br />THE ESTABLISHMENT OF A NIGHT TIME JUVENILE CURFEW; CONTAINING <br />FINDINGS AND OTHER PROVISIONS RELATING TO THE FOREGOING <br />SUBJECT; DECLARING CERTAIN CONDUCT TO BE UNLAWFUL AND <br />PROVIDING PENALTIES THEREFOR; PROVIDING FOR SEVERABILITY; <br />PROVIDING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />Motion was made by Councilperson Maxwell to adopt Ordinance <br />93-1887-A as read by the City Attorney. The motion died for <br />lack of a second. <br />Motion was made by Councilperson Cooper to amend the ordinance <br />to include only the under 17 year olds to be considered minors <br />provision. Second by Councilperson Maxwell. The motion <br />failed, 2 ayes and 7 nays. <br />
