Minutes Regular Meeting <br />La Porte City Council <br />May 8, 1995, Page 8 <br />provide any company who did not have contractual obligations <br />to the City of La Porte. Of the seven (7) remaining companies <br />two are still requesting potable water services from the City <br />of La Porte, Akzo Chemi and Rohm and Haas. Mr. Joerns will <br />review some policy direction given at that meeting and how the <br />staff formatted into a contract document both in Utility <br />Extension Agreement and a Potable Water Service Agreement. <br />Mr. Joerns reviewed with Council the proposed policy for <br />providing water to industries outside the City (but within <br />extraterritorial jurisdiction); the proposed form of Water <br />Service Agreement; proposed form of utility Extension <br />Agreement. If Council approves the policy and form of the <br />agreements, then staff will utilize the policy and <br />accompanying documents. Council would still have final <br />approval of each industry's individual contract per terms of <br />both the established policy and Code of Ordinances. Council <br />would review and revise policies or enter into other <br />agreements as they see fit. Mr. Joerns stated, "Council does <br />not have to enter into an agreement with any of the requesting <br />companies. It will be on a case by case basis." <br />Mayor Malone read: Consider policy for providing potable <br />water service to areas outside the corporate limits of La <br />Porte, approve form of water service agreement, and utility <br />extension agreement. <br />Motion was made by Councilperson Sutherland to approve the <br />policy providing water to industries outside City's corporate <br />limits and approve as to form the Water Service Agreement and <br />Utility Extension Agreement as read by Mayor Malone. Second <br />by Councilperson McLaughlin. The motion carried, 9 ayes and <br />0 nays. <br />Ayes: Councilpersons Sutherland, Cooper, Thrower, <br />McLaughlin, Porter, Gay, Maxwell, Clarke and Mayor <br />Malone <br />Nays: None <br />15. CONSIDER AWARDING SEASONAL CONCESSION OPERATIONS, SUBJECT TO <br />SPECIFIED CONDITIONS. TO CASUAL CATERING FOR CONCESSION <br />OPERATIONS AT THE LITTLE CEDAR BAYOU WAVE POOL - S. Barr <br />Director of Parks and Recreation Stephen Barr reviewed the <br />summary and recommendations to award seasonal concession <br />operations, subject to the specified conditions, to Casual <br />Catering for concession operations at the Little Cedar Bayou <br />Wave Pool. <br />
