Recommendation of Staff - The Planning and Zoning Commission recommends for Council to approve Rezone Request #R04-008 as presented by Mr, Sabo. The Public Hearing was closed at 7:05 p.m. 8. Council to consider approval of Ordinance 1501-ZZZ as presented by Mr. Sabo. Assistant City Attorney Clark Askins read: ORDINANCE 1501-ZZZ - AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY CHANGING THE ZONING COMMERCIAL AS REQUESTED FOR THE PROPERTY LOCATED AT 9702 & 9710 SPENCER HIGHWAY HEREIN DESCRIBED; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilmember Clausen to approve Ordinance 1501-ZZZ as Dresented bv Mr. Sabo. Second by Councilmember Engelken, Motion carried, Ayes: Beasley, Mosteit, Engelken, Moser, Rigby, Clausen, Porter and Griffiths Nays: None Abstain: None 9. Council to consider approving a takings resolution for an approximate '10 ft. x 15 ft. parcel at the northeast comer of North 23rd Street and Spencer Highway, Interim Planning Director Wayne Sabo presented summary and recommendation and answered Council's questions, Mayor Porter read: RESOLUTION 2004-15 - A RESOLUTION AUTHORIZING THE ACQUISITION OF TRACTS OF LAND FOR THE COMPLETION OF A POLICE STATION AND MAINTENANCE PURPOSES IN THE CITY OF LA PORTE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF, Motion was made by Councilmember Griffiths to aDDrove Resolution 2004-15 as presented by Mr. Sabo. Second by Councilmember Moser, Motion carried. Ayes: Beasley, Mosteit, Engelken, Moser, Rigby, Clausen, Porter and Griffiths Nays: None Abstain: None 10. Council to consider approving a takings resolution for approximately 2,9724 acres ofland to be used to construct channel F 1 0 1-06-0 I for drainage purposes. Assistant City Manager John Joerns presented summary and recommendation and answered Council's questions, Assistant City Attorney Clark Askins read: RESOLUTION 2004-13 - A RESOLUTION AUTHORIZING THE ACQUISITION OF TRACTS OF LAND FOR DRAINAGE AND FLOOD CONTROL PURPOSES IN THE CITY OF LA PORTE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made bv Councilmember Clausen to approve Resolution 2004-13 as Dresented bv Mr. Joems. Second by Councilmember Mosteit. Motion carried.
