Council to consider approval or other action regarding Ordinance 1501-M5 <br /> <br />Assistant City Attorney Clark Askins read: Ordinance 1501-M5- CONSIDER APPROVAL <br />OR OTHER ACTION REGARDING AN ORDINANCE AMENDING CHAPTER 106, <br />"ZONING" OF THE CODE OF ORDINANCE OF THE CITY OF LA PORTE, BY <br />GRANTING A SPECIAL CONDITIONAL USE PERMIT # SCU06-007 FOR THAT <br />CERTAIN PARCEL OF LAND DESCRIBED AS FOLLOWS, TO-WIT; 10.115 ACRE <br />TRACT, BEING RESERVE G2, OUT OF :f: 207 ACRES OF LAND (ALONG OLD <br />UNDERWOOD ROAD SOUTH OF STATE HIGHWAY 225) IN THE ENOCH BRINSON <br />SURVEY, ABSTRACT - 5, LA PORTE HARRIS COUNTY, TEXAS FOR THE <br />PURPOSE OF DEVELOPING OFFICE/WAREHOUSE FACILITY FOR FREEZER <br />COMP ANY IN A PLANNED UNIT DEVELOPMENT (PUD) ZONE MAKING <br />CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Council member Mosteit to approve Ordinance 1501-M5 as <br />recommended by Planning and Zoning Commission. Second by Council member Moser. <br />The motion carried. <br /> <br />Ayes: Mosteit, Engelken, Rigby, Moser, Ebow, Clausen, and Mayor. <br />Nays: None <br />Abstain: None <br /> <br />13. Council to consider approval or other action regarding an ordinance to allow joint venture <br />agreement with Frontier Logistics, the Port of Houston and the City to construct and <br />maintain a temporary road along the 4th and N. H Street ROWs for ingress and egress for <br />trucks servicing Port activities. <br /> <br />Planning Director Wayne Sabo presented summary and recommendation and answered <br />Council's questions. <br /> <br />Assistant City Attorney Clark Askins read: ORDINANCE 2961 -AN ORDINANCE <br />APPROVING AND AUTHORIZING A JOINT VENTURE AGREEMENT AMONG THE <br />CITY OF LA PORTE, THE PORT OF HOUSTON AUTHORITY, AND FRONTIER <br />LOGISTICS, L.P., FOR CONSTRUCTION AND MAINTENANCE OF A TEMPORARY <br />ROAD ON 4TH STREET AND H STREET RIGHTS-OF-WAY, BETWEEN BARBOUR'S <br />CUT BOULEVARD AND NORTH BROADWAY STREET MAKING VARIOUS <br />FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Council member Rigby to approve Ordinance 2961 as presented by <br />Mr. Sabo.
