Outlot 37 Replat - La Port~utlots Subdivision <br />5/15/97 - P & Z Meeting <br />Page 2 of 3 <br />~ The replat has been approved by .the Commission after being prepared <br />and filed as though it were an original plat as specified in Section 4.04 of <br />the Development Ordinance. <br />• All expenses incurred by the City or the subdivider in the replat process <br />shall be borne by the subdivider, including the cost for notice of public <br />hearing. <br />Payment of $175.00 per lot, of money in lieu park land dedication is <br />required by Section 12.02 of the Development Ordinance since there is <br />more than one residential homesite proposed. However, in this case the <br />owner wishes to sudivide his property to provide a family member with a <br />115' X 300' tract for the construction of a new single family home. No <br />other home sites are proposed. The existing home on Tract 37-A and the <br />proposed home on Tract 37-B will be accessible by a common <br />16'ingress/egress easement as well as a frontage on North D Street. <br />Conclusion: Section 5.02 of the Development Ordinance addresses the need for <br />sidewalks, where required by the Comprehensive Plan. or by the <br />Commission. Subdivision sidewalks are normally required by the <br />Commission. However, there are no interior streets in the subdivision and <br />the area is rural in nature. Typically, sidewalks are not required in this <br />situation. Staff recommends the same consideration for this replat. <br />Utilities are available this portion ofN. D Street. Both tract 37-A and 37- <br />B have frontage along N. D Street; therefore, utilities are available. <br />Staff finds the requested replat of Outlots 37, La Porte Outlots satisfies most <br />of the applicable provisions of State Law and City Ordinance. <br />
