' ~ • <br />• Page 2 of 6 <br />Section 5-700, Table B residential establishes setback <br />requirements for ~ <br />Recreational Buildings. As setbacks are, in this instance <br />established by use instead of by zone, these setbacks are <br />applicable even though this particular facility is located on <br />property zoned for General Commercial use. The front setback <br />established for this type of building is thirty feet. The first <br />exception being requested by the City is to this setback <br />requirement. <br />•The second exception being requested by the City, is to the' <br />parking requirements. Under the provisions of Section 10-609, a <br />total of 113 on-site parking spaces are required for this <br />facility See Exhibit C). The City is requesting a reduction to <br />90 spaces. - <br />Section 11-605.2 both defines special exception and sets <br />criteria for approval of a request. This section states: <br />The term "special exception" shall mean a <br />deviation from the requirements of the Zoning . <br />Ordinance, specifically enumerated herein, <br />which shall be granted only in the following <br />instances, and then only when the Board finds <br />that such special exception will not <br />• adversely affect the value and use of <br />adjacent or neighboring property or be <br />contrary to the best public interest. <br />Section 11-605.2.b.1 allows a special exception to front <br />setback requirements in the following circumstances: <br />Any exception from the front yard <br />• requirements where the actual front <br />yard setback of any abutting lot <br />does not meet the front yard <br />~~ requirement. <br />.~-~ M~~p ~ The existing building which occupies Lts 8-13 and 20-25, has <br />a setback adjacent to First Street of approximately 17 feet. <br />This is 13 feet less than the required 30 feet. Additionally, <br />there is~ a--vita which projects from the rear of the building. <br />Agh this 12 ft. x 27 ft. section of the building is <br />schedule for demolition it currently extends to within 4 ft. of <br />the Fi st Street proper line. The building addition to be <br />constr ted on the abuttin lots (14-19) is therefore eligible to <br />• be con idered for the reque ted special exception. <br />
