CONTRACT REVIEW 200.325 <br />Recipient or subrecipient must make available, upon request, technical specifications on <br />proposed procurements to ensure the item or service is the one being proposed for acquisition. <br />Typically, the review takes place prior to procurement but can occur post solicitation. <br />Recipient or subrecipient must make available for the awarding agency procurement documents <br />when: <br />Procurement processes or standards fail to comply to 2 CFR 200 <br />Procurement are expected to exceed $150,000 and is to be awarded without <br />competition or is awarded under sealed bid to entities other than the low bidder, <br />specifies a "brand name", or is a contract modification that changes the scope or <br />increases the scope by more than $150,000 <br />Grantees may also request that its procurement process be reviewed by the <br />awarding agency to determine whether its process meets these standards <br />BONDING REQUIREMENTS 200.326 <br />Bonding is required for construction/facility improvements exceeding $50,000. This is to ensure <br />that the Federal interest in the procurement is adequately protected. <br />o A bid guarantee equal to 5% of the bid price to ensure that post bid selection that <br />the successful bidder will enter into a binding agreement for the work <br />o A performance bond to secure fulfillment of the contractor's obligations for 100% <br />of the contract price <br />o A 100% payment bond to ensure payment as required by law of all persons <br />supplying labor and materials in performance of work specified in the contract. <br />CONTRACT PROVISIONS 200.327 <br />The recipient's or subrecipient's contracts must contain the applicable provisions in Appendix 11. <br />See Exhibit attached. <br />
