(f) To the extent consistent with established practices and legal requirements applicable to the <br />recipient or sub recipient, this subpart does not prohibit recipients or subrecipients from <br />developing written procedures for procurement transactions that incorporate a scoring <br />mechanism that rewards bidders that commit to specific numbers and types of U.S. jobs, <br />minimum compensations, benefits, on-the-job training for employees making work <br />products or providing services on a contract, and other worker protections. This subpart <br />also does not prohibit recipients and subrecipients from making inquiries of bidders about <br />these subjects and assessing the responses. Any scoring mechanism must be consistent with <br />the U.S. Constitution, applicable Federal statutes and regulations, and the terns and <br />conditions of the Federal award. <br />(g) Noncompetitive procurements can only be awarded in accordance with 200.320(c). <br />200320 (a-t) PROCUREMENT METHODS <br />(a) Micro -Purchases, $2,000 or less, do not require competition or a cost/price analysis, but must <br />be distributed equitability among qualified suppliers (to the extent practicable). <br />Construction over $2,000 is subject to the Davis -Bacon Act. Micro -purchases may be awarded <br />without soliciting competitive quotation if the entity considers the price to be reasonable. <br />(b) Simplified acquisition, The aggregate dollar amount of the procurement transaction is higher <br />than the micro -purchase threshold but does not exceed the simplified acquisition threshold. If <br />simplified acquisition procedures are used, price or rate quotations must be obtained from an <br />adequate number of qualified sources. Unless specified by the Federal agency, the recipient or <br />subrecipient may exercise judgement in determining what number is adequate. <br />(c) Small Purchases, $3,000-$49,999, price and rate quotes must he obtained from an adequate <br />number of qualified sources, no cost/price analysis is required <br />(d) Sealed Bid, $50,000 and above using firm price contract. Bids are publicly solicited and a <br />firm fixed price contract (lump sum or unit price) is awarded to the responsible bidder whose <br />bid, conforming with all the material terms and conditions of the invitation for bids is the lowest <br />in price. The sealed bid method is the preferred method for procuring construction. In order for <br />sealed bidding to be feasible, the following requirements should apply <br />o A complete, adequate and realistic specification or purchase description is <br />available <br />o Two or more responsible bidders participate <br />o The invitation for bids will be publicly advertised and bids must be solicited from <br />an adequate number of known suppliers <br />o The invitation for bids, which will include any specifications and pertinent <br />attachments, must define the items or services in order for the bidder to properly <br />respond <br />o All bids will be publicly opened at the time and place prescribed in the invitation <br />to bid. <br />o Any and all bids may be rejected if there is a sound documented reason. <br />
