PlanningandZoningCommissionRegularMeeting <br />September25,2014 <br />SCUP,CSTConvenienceStoreandGasStation <br />wouldprohibitovernightparkingandnotincludingshowersorotheramenities <br />commonwithatraditionaltruckstop. <br />Section106217oftheZoningOrdinanceoutlinesspecificconditionsforapprovalof <br />SCUPapplications.Therearethreedifferentconditionsthatmustbemetinorderto <br />approveaSCUP.ThefollowingtableidentifieseachofthethreeconditionsandƭƷğŅŅƭ <br />findingoneach: <br />Condition:StaffAnalysis: <br />(1)ThatthespecificusewillbeTheproposeduseisconsistentandcompatiblewiththeĭźƷǤƭ <br />compatiblewithandnotComprehensivePlanasapprovedbytheCityCouncil.Thelocationof <br />injurioustotheuseandthesiteisonthewestsideofHighway146inthePortCrossing <br />enjoymentofotherproperty,BusinessParkandtheproposedusewouldbecompatiblewithfuture <br />norsignificantlydiminishorusesinthebusinesspark.Additionally,theapplicanthasagreedto <br />impairpropertyvalueswithinfurtherrestrictionstoensurethatthesitedoesnotdevelopasatruck <br />theimmediatevicinity.stop. <br />DuetothelocationofthesiteincloseproximitytothePortCrossing <br />BusinessParkandthe18wheelertrafficassociatedwiththe <br />developmentthereaswellasthefactthatHighway146isa <br />designatedtruckroute,thesitewillattract18wheelertrafficfor <br />aresult,staffrecommendssubmittalofatraffic <br />fuelingpurposes.As <br />impactstudythatwillneedtodemonstrateminimalimpactofthe <br />proposeddevelopmentontheintersection,especiallytotheportion <br />ofWhartonWeemsbetweenHighway146andBroadwaywhichis <br />usedmorebyresidential/localtrafficpatternsasopposedtotruck <br />trafficandperformanynecessarymitigation. <br />(2)ThattheconditionsplacedonAsaconditionofapprovaloftheproposedSCUP,theapplicantis <br />suchuseasspecifiedineachrequiredtosubmitasitedevelopmentplaninaccordancewiththe <br />districthavebeenmetbytherequirementsoftheĭźƷǤƭDevelopmentOrdinance.Additionally,the <br />developmentplanwillneedtocomplywithallotherprovisionsof <br />applicant.site <br />theĭźƷǤƭZoningOrdinanceandwillbereviewedduringthesite <br />developmentreview. <br />(3)ThattheapplicanthasagreedTheapplicantwillneedtoconfirmontherecordatthepublichearing <br />tomeetanyadditionalthattheyareagreeabletotheconditionsimposedontheSCUP.Staff <br />conditionsimposed,basedonhasprovidedalistofconditionsaspartofthisreport.However,the <br />specificsiteconstraints,andCommissionandCityCouncilmayimposeadditionalconditions, <br />necessarytoprotectthepublicshouldtheyapprovetheproposedSCUP. <br />interestandwelfareofthe <br />community. <br />ShouldthePlanningandZoningCommissionrecommendapprovaloftherequested <br />SCUPapplication,staffrecommendsthefollowingconditionsbeconsidered: <br />1.Asitedevelopmentplanshallbesubmittedinaccordancewithapplicable <br />requirementsoftheCityofLatƚƩƷĻƭDevelopmentOrdinance. <br />5 <br /> <br />
